Falsely cited for not wearing seatbelt...

just got falsely cited for not wearing a seatbelt (I had it on the entire drive of course, as I ALWAYS do). Boy, did he pick the WRONG guy to try and revenue. Now I get to go through the whole martyr thing, refusing to pay the fine, court costs, etc...and I'm pretty sure I'm going to file a small suit as well, requesting my time and emotional damages. I won't win that, but it seems like the right thing to do.

On top of everything else, the driver of the vehicle is a retired LAPD officer. ROFL.

Courts charge you for their time, seems only fitting to pay them in kind. And without question this kind of thing exacerbates my distrust and dislike of governments, and causes me stress, which is a direct physical harm (especially to someo...ne with a heart condition who's already in a very stressful situation). I'm planning on charging for my time (researching, preparing, and attending court, @ $15/hr, and then $125 distress, which is $1 more than the ticket is for). Like I said, I know I won't win that one, but it's the right thing to do.
 
Not following exactly....So, he stops you, you actually have the seat belt on, and he still cites you for NOT having it on?
 
My word, and the retired LAPD officer with me. But still, I realize that. Unfortunately I'm a pure idealist, so I will not be paying a thing, regardless.

I had a colleague who was an idealist. Out of principle, he didn't pay taxes for a couple of years. The gov't made an example out of him and put him in jail for 6 months.
 
Don't those cop cars have cameras on the front? Surely if you are innocent you could use that in your case very easily.

I have a difficult time remaining calm when someone out and out accuses me of something I did not do.

Don't they have dashcams in their cars? This may be able to prove your innocence.
 
Please...tell the judge your story, refuse to pay any fine and court costs...then, when you get out of jail, report back to us. Good luck with your lawsuit...🙄 Yes, this is the USA, where you can sue anyone for anything...but you don't always win. I'll be surprised if this isn't thrown out as a frivolous lawsuit.
 
Happened to me too a few years back. I was working on the new house and was looking pretty scruffy driving a brand new van, I am sure he thought he was going to make a major bust.

Judge even asked the officer if I was wearing the belt when I was pulled over, he responded yes, 2 weeks later a bill for $100.

Remember, the cops word is always taken before yours, he is of course a far better person than you and would never tell a lie
 
If your car has a black box, it probably records seat belt use.

Of course it's probably too late to retrieve the proof now...

You can't go to jail for a traffic infraction, nor can you go for a debt. However, I'd go for the rest of my life before I'd pay $.01.
