False Hit and Run Claim

So I rented a U-Haul truck on Sept. 9th 2014 around noon on Gray Hwy in Macon, GA. It was my first time driving one myself so I was very careful and drove directly to my apartment that I was leaving, but I was there until about 4 or 5 loading my stuff, and then to my parents house in Stone Mountain, GA, where I returned the U-Haul the next morning with no damage or issues. Next month, on Oct. 2, after a recent surgery, I received a call from Repwest, U-Haul's insurance company, saying they have a lady saying she parked on Gray Hwy somewhere when I backed my U-Haul into her car while she held her grandkid who hit his head, claiming a hit-and-run.

I am pretty positive I wasn't in any kind of accident. The insurance lady who I thought should be representing me is already asking for my insurance as if they have investigated and know that I did this. She says they have a police report and a witness, but I have yet to hear from any police officer and U-haul and their insurance company has my phone# and current address. They
hit me with this crap nearly a month after the so called accident as I'm trying recover from fibroid surgery. Crazy. Sorry I couldn't make this shorter.
Any thoughts?

I'd call the police department and ask for a copy of the accident report.

I didn't miss it, but you did put a qualifier in that statement---pretty positive---which means you possibly could have been in an accident and not been aware of it.

That sounds to me like you aren't 100% positive that you weren't in a accident. Am I interpreting that wrong? Personally speaking, after many years with a drivers license, I have never had any doubt when I have been, or have not been, in an accident.

That being said, do not trust that anyone calling you is who they say they are. It could be some sort of con. DO NOT use caller ID/phone history or any number they may have given you to call them back. Although unlikely, you want to make sure someone isn't pretending to be the insurance company as part of a scam. Use the internet or your receipts to get phone numbers for U-Haul and the insurance company and verify that a claim has indeed been made.

If a false claim has been made, tell U-Haul and their insurance company it is false and contact appropriate law enforcement and let them know what is going on.

jlee in post #2 gave you the best advice so far. I'm sorry to tell you that you are going to lose the question is to what degree. I'm assuming you bought some form of insurance through U-Haul on that rental. Well, they're going to pay out on it because it's the cheapest path for them and they want to minimize or negate any bad publicity. What you need to find out is what affect is that going to have on you personally. It doesn't matter at this point whether you did or didn't back into them. Our world is full of scammers who will play the system like this for profit.

So, my advice would be to ensure that the insurance rep is truly looking out for your best interests which may mean calling an attorney. I can guarantee you that you are not #1 on the list. You need to find out if you're #2 or even on the list at all.

Edit: I got distracted and took forever to compose this. You've gotten some other good advice IMO, specifically from KeithP.

Like JLee said, get the report. There might be some detail in there that confirms their story, or completely disproves it. Do you ever remember backing up on Gray Highway? How would some kid hit is head on a divided highway in the first place?

Frankly, I wouldn't be surprised if it's a fraudulent claim. I've seen it happen more than once before, more often than REAL insurance claims in my limited experience.

was there damage to the back end of the truck when you did the walk around when you returned it? You had to sign a damage sheet when you picket it up. Hope you kept your documentation. Take that documentation and the police report to a lawyer.

OP says the truck was returned with no damage. If it was a hard enough hit to cause a head injury, I'd think you'd feel it..even in a moving truck.

I didn't read OP as saying that the "accident" caused the injury, just that she was out of the car tending to her grandchild's head when it occured. OP - can you clarify?

If you backed into someone hard enough for them to 'hit their head' you would have known it. Incidental contact like a scrape in a big truck might not be noticeable. More than likely they are fishing for a settlement.

I wouldn't put it past uhaul being complicit in this demand. I hope your walk around at the end included taking photos. I always do whenever I pick up and return rentals. The next letter you get will probably be from uhaul asking for money to repair their truck and money for time out of service.

How/why would she be holding the grandchild in the vehicle such that the child hit the head.

Unless an infant and she was placing/removing into a car seat.

There is more to this story. I don't know what, but I'd bet nickels to rat turds there is at least one critical piece of information being withheld.
