For what goods? New goods and services are taxed. In order for these items not to be taxed then at least two people have to be in on the deal (buyer and seller). Auditing should be easier since the IRS would have to go from auditing millions of individuals down to auditing hundreds of thousands of businesses. Additionally, those comitting the fraud would not be able to completely avoid the tax. At some point, their blackmarket earnings will be taxed when they go out and buy food or other new items.

Even then, if you want to avoid the Fair Tax...only buy used goods...which is perfectly legal.

No tax system is going to come up with a 100% foolproof way of avoiding tax cheats. Because there will always be people who come up with ways of avoiding taxes.
 
everyday goods that are above a certain price point. You know those little shops in chinatown where they sell counterfeit goods?

it will be like that except they'll be selling real goods and more variety, like expensive booze and tvs. Wanna get you car fixed? Instead of going to the dealer you'll work out a cash deal with a local mechanic that will do the work at a 25% discount.

stuff like that.

also if you tax people heavily on what they spend, spending will slow.

a) not necessarily as now you're using pre-tax dollars instead of post-tax dollars
b) if you're not spending you're saving, and the savings rate is pretty piss poor in this country.
