Fair Use question....answers regarding file sharing

According to CONFU it is legal to make a copy of a program for archival purposes only. If that archived copy is availible on a file sharing program, what then? This has immeadiate implications on a current situation that a friend is involved in. Any knowledge of cases or statements that have been made?

It was a program and because hes stupid he accidently shared his entire hard drive on DC++.
