Factory Overclocked 7800 Card Crashes?

I have an overclocked eVGA 7800GT and it never crashes at the facotory overclock only when I treak it a little.
 
If they overclock it past the specs and guarantee it to work at those specs and it doesn't, then it's time to send it back or get your money back. That's claim for an RMA. It's the same idea as when you by ram rated at a certain speed and it doesn't go to that speed.

yes, if you dont OC it past the factory OC as long as it is within warranty
XFX has a double lifetime warranty
 
According to anandtechs 7800GT lineup. The eVGA was the top of all the manufactures in FPS, also the lowest price of the bunch. Also the best overclocker i belive.
