The Gaga Saga

Cliffs Notes:
  • Weird Al wants to parody a Gaga song for the lead single on his new album.
  • Because of the intention of the original song, he decides to give all proceeds from the single and video to the Human Rights Campaign
  • Asks Gaga for permission to release the (as yet unwritten) parody, she says she needs to hear it first
  • Weird Al writes the lyrics, presents them
  • She insists that she needs to actually HEAR the song, even though she wrote the original music that the lyrics go to
  • Weird Al records/mixes/masters the single, presents it to Gaga
  • Her response: No. No explanation
  • Because Weird Al has integrity he does not release the song on the album even though he legally could
  • Fuck Lady Gaga

He did however release the song on Youtube, which you can find here.

Frankly I don't think the parody is very good, but I still think it's a bitch move from Lady Gaga.

It's her choice. Sucks that she made him go through all that though.
Technically it's not. He can legally parody her under fair use rules, but he has a personal policy to not release parodies on albums without the original artist's permission.

Why does she have a problem with him releasing a harmless, unoffensive parody for charity?

some contracts grant the music studios rights to the songs, so gaga may not even be able to give permission to weird al if she wanted to.

The question I have to ask, who owns the rights to the song, lady gag, or the music studio, and go from there.

The other day I was looking at the marvel comics channel on youtube. I think there was a copyright notice that the video had been removed due to a copyright claim by warner brothers? How could the production studio file a copyright claim against Marvel, when marvel owns the rights to the movie? A few weeks later the video was unblocked.

Again a non issue..
this is merely 1 artist asking for personal permission not professional as he legally does not have to.

You (and many others) don't seem to understand. He doesn't need the song's owner to give permission. Fair use laws. Read them.

Do you understand that it's possible to be a complete asshole and still be within your rights? That's what I'm saying here - sure, she had the right to say no. And it makes her a bitch. Are you seriously this dense?

Fair use or not, that does not stop people from suing each other.

Look up copyright troll RightHaven sometime, then get back to me about fair use. Companies like righthaven are suing for reposting the slightest exert.

If it's not that great of a song, why are you guys surprised Gaga doesn't want him to release it?

I like Weird Al, but clearly not all of his songs are as good as Amish Paradise or Eat It. If he made a shit version of one of my songs I wouldn't be thrilled about him releasing it either.
