NEW YORK – A New Jersey woman was stabbed in the face with a pen on a New York City subway train after she tried to stop a man from lighting a cigarette.

The assault occurred on a crowded No. 3 train near the Chambers Street station during Tuesday's morning rush.

Witnesses told the Daily News and the New York Post that an argument quickly escalated when Evelyn Seeger asked the man not to smoke. The witnesses say two riders were trying to restrain the man when he pulled out a pen and slashed Seeger's face.

Seeger, of Nutley, N.J., was treated at a hospital and released.

Police charged the man with felony assault and criminal possession of a weapon.

hopefully the reporter would have said "pen knife" if that were the case. i also own a few different styles of knives hidden in pens like that. id never risk actually using one tho, id be afraid id never get it back from the cops.

I guess it's fine if you just collect them, but otherwise if you're never going to use it why bother having it...

Anything is a weapon if it's used as such. A knife is a tool up until I stab someone. Same with a hammer, bat, etc.

I believe that the law in many places views any object used in an attack as an "illegal weapon". It was just a pen until he started using it as a weapon.

Intent has a lot to do with it as well. I carry several bats in my car because I coach softball, but if I told a cop I carried them for self defense then they could be considered illegal weapons.
