(Reuters) - A secretive U.S. Drug Enforcement Administration unit is funneling information from intelligence intercepts, wiretaps, informants and a massive database of telephone records to authorities across the nation to help them launch criminal investigations of Americans.

Although these cases rarely involve national security issues, documents reviewed by Reuters show that law enforcement agents have been directed to conceal how such investigations truly begin - not only from defense lawyers but also sometimes from prosecutors and judges.

THE SPECIAL OPERATIONS DIVISION

The unit of the DEA that distributes the information is called the Special Operations Division, or SOD. Two dozen partner agencies comprise the unit, including the FBI, CIA, NSA, Internal Revenue Service and the Department of Homeland Security. It was created in 1994 to combat Latin American drug cartels and has grown from several dozen employees to several hundred.

Today, much of the SOD's work is classified, and officials asked that its precise location in Virginia not be revealed. The documents reviewed by Reuters are marked "Law Enforcement Sensitive," a government categorization that is meant to keep them confidential.

i agree. Though they should not be spying on everyone and useing that to find crimes.

This is a major overstep of its powers.

Important context:

Wiretap tips forwarded by the SOD usually come from foreign governments, U.S. intelligence agencies or court-authorized domestic phone recordings. Because warrantless eavesdropping on Americans is illegal, tips from intelligence agencies are generally not forwarded to the SOD until a caller's citizenship can be verified, according to one senior law enforcement official and one former U.S. military intelligence analyst.

This is another reason why vigorous oversight is needed to make sure that actually happens, however.

To me this is primarily a story about the DEA massively abusing people's civil rights, it isn't really about the NSA. Not that I imagine they are entirely innocent here, but the real scandal is not allowing people to actually challenge the evidence used against them in court. That's so absolutely wrong it's not even funny. Fuck the DEA.

That's not what the article is about, and there's no reason from that article to bash all spying programs equally.

The issue in the article is that the DEA is not telling people they are arresting where they got the information. That is almost certainly unconstitutional. I think we all WANT US government spying agencies tipping off law enforcement on criminal activity they get through warrantless wiretaps so long as it is not targeting American citizens. If there are indications that this is happening frequently and that evidence is being used, that's a problem.

Right, and that's a good thing as we all want the DEA to use NSA data so long as they aren't using it against people protected by the 4th amendment.

I want the DEA to do nothing but fuck themselves to death with a parking cone. Bunch of power hungry assholes that fight any attempts to reform the law and erode their powers, even as our prisons are having to release people on the streets due to overcrowding. Every time they fail its a victory for the American people.

Things that are acceptable for NSA data to be used for:

1. To prevent violent acts of terrorism.

2. Nothing else.

If this becomes a big enough scandal, maybe the NSA scope will be altered (or at least the access to the NSA's resources be changed).

We're lucky if this is the only off label use of this data that is occurring. Corporate espionage and manipulation of the political system are the two juiciest uses. So juicy that regardless of original intent of the system that it being used extensively for those things is inevitable and probably already occurring.

Well I don't really want the NSA to only deal with terrorism. There are lots of foreign governments and organizations they should be spying on as well.

I mean they are all spying on us, seems only right that we return the favor.

Which is fine as long as that data isn't even on the same dataserver as the data about American citizens. And the DEA, IRS, someotherthreeletteragency can't get their hands on any of it.
