Ever have someone falsely accuse you of bodily injury from a car accident?

Just happened today around 7:20am. Just got in a minor accident (ended up hitting lady's rear bumper < 10mph. I took a video asking her if she was okay etc, took pics etc, then got to work and called my insurance company telling them everything.

Anyway, you guys ever got into an accident where a person said otherwise and claimed more damage + bodily injury on you?

I guess, if everything pans out normally, do I just pay the deductible and get an increase on my premium for the next 3 years?

But the insurance company will do everything possible to screw them over. Trust me.

I'm willing to bet even that won't stop you from texting/surfing while driving though, will it?

Well, I wasn't texting or surfing. Lady was driving an SUV so I couldn't see in front of me until she stopped so abruptly because of debris on the road (3xorange cones on the floor of the freeway). Good try though. I was actually cooking my omelette when this incident occurred.

BTW, we were going about 65-70mph to a halt... so I estimated I hit her at about <10 (tap) from behind her.

I had some loser truck driver turn into my lane and run me out of it. I barely touched and broke just a taillight of someone in front of me when I was trying not to get killed by the semi.

The douchebag I broke the taillight of tells the insurance company that he's going to need thousands of dollars of back and massage therapy.

Flipping insurance company doesn't even fight it. Just pays it and raises my rates. It was probably $100 of damage to replace the taillight. It would not have raised my rates under my policy. But once it hits over $1000 it does.

So I ended up having to pay thousands over the next few years for a $100 taillight that wasn't my fault really.

People are A-holes.

And that was Allstate by the way. I canceled right then and there so they didn't get a penny more at least.

Not me personally, but a close friend for work had this happen.

He was in a parking lot, and accidentally reversed into a car that had just pulled into the parking space behind. He brushed it at about 2 mph, probably less. Neither car had any visible damage.

However, the occupant his wife and 2 children all got out, holding their necks and complaining of neck pain and pins-and-needles in their hands.

The insurance company just paid out $15k in injury compensation + $1k for a replacement bumper for a rust-bucket 1995 hyundai elantra.

He's just got the quote through for next year's insurance - it's more than doubled to nearly $2k.

I rolled into a car once not under power.. Situation was we were both turning right at a stopsign. He was in front, I was watching him and he started to go. I looked left ( to see If I had enough time to go). There were no cars coming, I let out the clutch a bit and put back in to roll forward as I looked back he stopped about 1/2 way into the turn and I rolled into the back tail light.

I literally wasnt under power, but was in a Tacoma, and he had some shitbox little commuter car. It basically crunched his taillight, but did no damage to the car at all.. Again, literally maybe 1-2mph just rolling forward to my turn at the stop.

Accident was my fault, I didnt take into accout the guy was a moron and could/would stop for no reason. We trade insurance, and had my insurace fix his car, no issues from me.

I had a clean driving record, so the 1 point from accident would not make my rates go up. Turns out, he had developed a "neck" injury and my insurance company settled with him for a $500 check. Problem is for me, since there was an "injury" I got 2 points instead of one.

Win for the guy, as he gets a free $500 check.. Win for the ins company, they will get around $1500 in increased premiums over the course of the point falling off. Lose for me, I am out the extra cash.

I ended up fighting it, complaining, threatening to move my policies ( home, boat, motorcycle and car).. After I spent about 8 hours additional of my time they ended up agreeing to remove the point.

I changed insurance companies anyway when my policy expired, because fuck them.

He seemed perfectly normal, I just suspected he crammed on his brakes to answer the phone, or reach down and grab something. In hindsight, he may have been one of those accident scammers because he did stop for absolutely no reason halfway into the lane.

Lesson learned, now I watch them go all the way through the turn before I proceed ;)

Similar thing happened to me. Was snowing pretty good, and this lady decides to stop on a green light (probably saw the walk signals flashing). I wasn't following close, nor going fast, but a combination of the snow and her stopping quickly led to me lightly bumping her bumper.

She gets out in a fit, talking about scratches and dents and its going to cost her $1,000 to fix... I wipe off the area with a towel, and show her she has no dents nor even scratches. Her bumper must have flexed a little, but that was all.

Trade info, go home. Later talk to my insurance agent, and the woman says she has whiplash. Now again, the force I hit her, is comparable to having someone standing outside and pushing on your car so it rocks a little.

Guess she couldn't find a doctor to believe her, since she dropped the issue soon after.

Similar thing happened to me. I was behind a huge pickup, going 25 coming up to a light. It all of a sudden swerved and turned left, without even pressing the brakes.

Turns out there was a large line up of traffic stopped at a green light. I laid on my brakes and barely nudged the lady in front of me. I had a geo metro, she had a toyota corolla. Neither car can handle anything close to 5mph without the bumpers needing to be replaced.

We all exchanged info, everyone was alright. And we part ways. I report it to my insurance, they hear nothing from her. 29 days later I get a notice form an attorney, one of those late night TV ones, claiming she was hurt and needed all kinds of chiropractic care etc. And saying that we are also being sued because we didn't report an injury accident to the police within 30 days.

Well I went down and reported, and included in the report her information, and that this was the first time she had informed me of being injured.

Ended up her insurance and mine agreed upon mediation to sort it out.

What she and her attorney didn't know, was that she had told me where she worked, and my room mate had gone over to check it out with his camcorder, which was connected to one of those online timekeeping sites. So it was almost guaranteed to have the correct date and time with the videos.

She worked at one of those boys/girls clubs that take care of kids for parents, from when they get out of school and the parents get out of work.

The day after the accident and for the next 4 weeks she was rolling around playing with youngsters on the floor. Showing no signs of pain or injury.

We presented the tapes to the mediator, along with pictures of our car and hers from the accident, that showed not a single scratch to either one.

The mediator basically gave her just enough money to pay the attorney's fee and the initial chiropractors consultation. And told the attorney that next time if someone approaches him with an injury from a car that can't even handle a 5mph bump without destroying the bumper, that he better hope it doesn't end up back in front of him.

The insurance company was happy we went through the trouble to help them fight it, and no increase in rates was seen.

My mother who use in a late 90's accord at the time rear ended an SUV. Totally was here fault, totaled the car as it went under the SUV, couple of hundred dollars worth of damage to the SUV. She was going 10-15 when she it, she was injured. Broke her Breastbone on the steering wheel (think open heart surgery type of injury) pre-airbag car.

The lady in the SUV claimed all kinds of back injury yet never missed work, she was military...... a Captain in the chairforce. Our insurance company offered $100k to settle which was the limit of our policy.

She declined so we go to court. Trial ensues our insurance company represents us covered under our policy, She wants millions. Jury hears the case for 3 days and my mother is freaking out. Jury awards the douche $87k insurance covers. Seems the insurance company see this sort of thing all the time and juries pick up on it and wont even award the money seekers more they they would have gotten had they just settled.
