it all depends. I've refused a breathayzer before, because I really was not drunk, I didn't have a drop of alcohol in me. They wanted to bring me in, and I told them they'd better be damn sure I'm drunk if they do that, otherwise I'll have some fun in court. They ended up letting me go.

The situation behind it was that I was sleeping in my car while leaving it running outside a nightclub. I was driving for 8 hours, and I didn't know it was a nightlcub, and it was cold as hell outside. I understand why it happened, but sometimes you have to put your foot down.

EDIT: I live in a state where they suspend your license for 6 months if you refuse a breathalyzer.

No, you would not have fun in court. You must submit to testing. You knew that when you got your license. Just take it and stfu or turn in your license.
 
No, last night I got taken in because they thought i was drunk, totalled my car because of some douchebag driving in the middle of the street around a sharp turn. Stayed locked up for 4 hours and was released with a ticket for driving in the wrong lane, because they really didnt know what happened but they had to give me something.
 
Yes 3 years ago for .12 over legal limit, was on my way to store around corner for cigs. Driving on well lit road at midnight and only had parking lights on which is why I got pulled over. Cop said I wasn't speeding, swerving, and said i was one of the only ppl who used their turn signal when pulled over. I cooperated and went to jail. Cost me about $2G's total (bail, lawyer, fines + fees) + 32 hours of picking up garbage on the side of the road (4 saturdays at starting @ 7AM). Lost license for 6 months too. Will never go on my record as long as I dont get another one in the next 5 years.

Lawyer advised me if ever pulled over say nothing to the cop. Just get out of your car when asked, lock the door, refuse field sobriety, breathalyzer etc... and let them take you to jail. Then when taken to court they have no proof and case gets dropped. Sure you might lose license for 6 months but you won't have a DUI with no proof.

Now I carry a business card for my favorite cab company in my wallet all the time. Even readable in blacklight so you can call straight from the club.

call BS all you want, but he got off. he went to court and faught it only to come out with a few fines and thats it. it pisses me off more than you can imagine...i have no reason to lie about it. i cant stand this guy. he is a complete moron and waste of life.

You probably also think I should let the cop search my car since I "have nothing to hide". Thanks, but I'll hold on to my rights while you allow yours to get trampled. And yes, I would have plenty of fun in court. I don't pay tickets out of convenience because I might miss a day of work. I fight them and I win. I won't be a contributor to the local revenue enhancement system just because it's "convenient".

I'll sit back and let the rest of you discuss this, I'm done with this thread.
 
Nope. Always make sure I leave enough time between drinking and driving to be a safe driver; if I plan on getting blitzed I'll just do it at a friend's house.
 
I was made to take the field sobriety tests once, and then even even took the breathalyzer, but I only blew a 0.04. I knew I was legal to drive when we left the party to come home, but my girlfriend's sister wanted to stop at 7-11 for cigarettes on our way. Sure enough, there were two cops in a cruiser right there in the parking lot.

My girlfriend had passed out in the passenger seat, and slumped forward over her seatbelt, so it looked kinda bad. That prompted the cops to come over and start questioning me. Stupid me, I admitted having some beers WAYYY earlier in the night, so they pulled me out and made me do the tests. I did fine, though.

That's as close as I've ever gotten to a DUI.

I was unaware that the United States Constitution guaranteed you the right to drive an automobile; it does however guarantee your right against unreasonable searches and seizures.
