Interestingly, Moto's firm seem to be the same guys defending Samsung.

That sucks for Apple. I don't see them changing the devices so Apple would be stuck if this follows through.

I find it funny that any lawsuit against Apple is justice and a godsend. Double standard I'd say.

No double standard- they started it. If they fail in court we all celebrate because it proves that not even the great Apple can avoid Karma.

Last I checked, they were the ones making all the news with lawsuit after lawsuit. People like to see karma in action, especially on a big scale like this.

The reason for that reaction is because Apple has been very lawsuit happy for years.

- Apple doesn't want to share the play ground.
- Apple picked a fight with Google and his friends.
- Google gave Motorola his lunch money to help fight Apple
- Apple gets his ass kicked out of the play ground for being such a douche.

That is easy. Google wants touchscreen smartphones to be a commodity. They push for minimal control which allows for maximum competition in the market, which helps us as consumers.

Meanwhile if Apple had their way smartphones would remain a luxury.

Exactly, I can go get an Android smartphone for < $100 with no contract. If Apple had its way, I would have to spend $600 or sign a 2 year contract for $2K and spend $200 for phone. Apple losing patent lawsuits saves consumers a lot of money.

Onto the Karma, I was under the impression in this case, Motorolla actually sued first. As always in these stories, Apple Sue, bad, apple sued good. Apple gets technologys copied from them Good, apple copies technology, bad. People should stop trying to hide behind words like Karma and just be honest.

Anyone think this is ubertrolling by the German judges?

If this carries on Germans will have to use two tin cans and a piece of string to communicate as every other form of communication tech will have a ban on it. :biggrin:

Given that so far everyone has been successful in Germany, I can see why so many of the lawsuits are being filed there. Reminds me of the U.S. court in East Texas that's also fairly famous for finding defendants as infringing.

Although the German market is quite large, it probably won't do much damage in the long run as it doesn't seem as though other countries are finding in favor of the plaintiff nearly as much. Also, even if everything or nearly everything were banned in Germany, it's not too difficult for German citizens to hop across the border to get what they want.

I never said it was out of the goodness of their hearts. In fact, I quite frankly don't give a damn why they do it. The end result is phone hardware is moving at a pace that computer hardware did back in the early 00s. Faster and cheaper is always better.

Yes, but unlike Apple Motorola gave them a chance to pay for a license instead of going to court:

The reason Apple's lawsuits are worse than the rest is because (unlike MS or Moto) they are not trying to shake down other companies for money. Instead they are trying to outright prevent products from being sold in the market.

As a consumer I don't like that MS is using its patents to shake down technology firms (and I hope B&N wins against them), but with that said I respect the fact that MS needs to protect its patents for them to be valuable. MS offers a way to pay for a license and still sell the product, and even though that maybe a way to give WM7 a competitive advantage at least in that system WM7 still has to compete.

Apple on the other hand has worked to outright ban Android products from the market. They aren't giving companies who they sue a way to pay them for a license, instead they are using the courts like mafia bosses use hitmen- to eliminate the competition.

As a consumer they are trying to restrict my choices, and therefore they are by far the worst company in this mess and I cheer when their relevant efforts fail.

People should stop trying to hide behind words like Karma and just be honest.

Sure, I'll be honest. I don't care who is right. I don't care who patented what or who invented what. I don't make a dime off of any of this stuff. I am just a consumer, I want what is best for consumers.

I respect Apple for creating the modern smartphone, but I don't think that gives them a right to own and control every derivative of their creation. I think their early mover advantage, and maybe some license fee, is the maximum they can get from their creation.

I care about having a competitive mobile market so each year I either get cheaper toys or more powerful toys. I care to have choices beyond Apple's stagnated iPhone line.

Which is absolutely genius. You basically force big corporations to pay for the cost of the phones. Obviously those big companies are making money off the advertisements, but it creates the circle of life. If Apple were smart they would do the same thing. Could you imagine how many apple products would get sold if they were able to sell their products cheaper? I probably would have bought the iMac I'm typing on from an Apple store instead of at half the cost from some rich college kid who got it thinking it was cool and realizing he can't play his favorite games on it.
