Ethics of Downloading

I've always been of the belief that file sharing of intellectual property/copyrighted works is immoral because the creators/facilitators are not being paid for their work.

with that assumption, could it be morally ok to illegally download a copyrighted work that is only availible through either illegally downloading it? examples would include roms of games that are no longer being produced in any form, or books that haven't been in print for decades.
 
so you think it's wrong to illegally download copyrighted material, but you want to find a loophole so you can download something that isn't readily available to purchase to make yourself feel better?

I don't need a loophole because I don't download copyrighted material... this was just an ethics quandry that was brought up in a conversation between my roommate and I last night.

Good luck on that. As long as Disney exists, copyrights past 1933 or so will never expire, in order to protect Mickey Mouse.
 
I just figured I would define the terms then pose a hypothetical. Morals are what you feel is right, ethics are what everyone else says is right.

Well what if you felt it was okay to download something, and everyone else didn't care: your morals are obviously okay, but where do ethics come into play, are they an ever changing entity based on societies views, or a long standing entity free of human interaction. In other words, ethics of the past said women should not expose their legs, but now they do. So maybe someday downloading will be seen in a different light based on the decline of capitalism.

Roms of old games have their copyrights upheld by the original company and are not legal for use. The game companies like to preserve the ability to resume old titles whenever they please and not let anyone else profit off their work, thus making them look really stupid.

They are legal if you have the game and used just as a back up 😀
