Mr. and Mrs. Pike are a bit odd here, and you may not agree with their comments, but they do have a good point about the bill. Holder's testimony before the senate, he keeps talking about the act is meant to protect groups that have had a historic problem of being attacked.
Everyone is equal, others are just more equal.

It is funny how the some of the most racist people in America are the ones who pretend they are fighting it.

Hopefully the recent SCOTUS ruling reminds congress that it is unconstitutional to put any group above another.

it is amazing. We are all supposed to have equal protection under the law. Holder acts like right now if a black man gets lynched by a white group, nothing happens and we need a hate bill to get them prosecuted.

They want to punish you for what you thought (hate) while you were committing the crime. Somehow I seem to equate punishing someone based upon an action as a method of controlling an action. If punish someone for jaywalking, I am attempting to control jaywalking, if I punish someone for what they think, I am trying to control thinking.

It is a slightly bad analogy because they are attempting to only control for thoughts during the commission of a crime, but they are attempting to punish someone for their thoughts and beliefs that motivated the crime. I am not completely comfortable with that idea.

Intent and motive factor into severity of the crime, it's nothing new. You beat someone up due to their race or sexual orientation, you are a bigger threat to society than someone who got into a fight because they had too much to drink.

How do you prove if the fight is motivated by race? The easy answer would be racial slurs shouted - but if they are not, there is no proof of a hate crime.

How do you prove if the fight is motivated by race? The easy answer would be racial slurs shouted - but if they are not, there is no proof of a hate crime.

Unanimous verdict by a jury, same way we prove every other crime.

When a prosecutor files "hate" charges against you, and tells the media that it was a "hate crime", you are done before you even sit on the stand.
