Count yourself lucky that you didn't his a car while driving you idiot! You are upset over a minor little scrape like that and yet you don't seem to notice that the important thing here is that no one else got hurt or KILLED. I will not share in your misery! Next time, which I hope there won't be, I hope you get stopped and taken to jail for DUI.

Screw your car, you deserved much worse.

3 beers in 3 hours is NOT "DUI" Far, Far, FAR from it.

"I wasn't driving drunk, but probably the next worst thing"

Would you let him drive your kid around(hypothetically)?

Saying you were close to DUI is too close IMO. If he couldn't park without doing that, he shouldn't have been driving.

He was talking about being tired genius.

it certainly doesnt help with only having 3 hours of sleep in the last 2 days.

Thank you nick1985.

With that little sleep its doubtful you could pass a field sobiety test with no beers.
I've worked those kinds of hours and one beer would put me down.

Just because he may have only blown a .09, by his admission you could have pushed him over with a feather.

3 beers in 3 hours is no where near a .09. More like .006 for a 150lb male. It wont even register on most test kits.

Study how breathalyzers are HIGHLY inaccurate.

What real scientist would test the way they do? (trying to compute COH in the blood based on COH in the breath, take the blood)

I will say absolutely I have driven (younger) totally fuked. When I was arrested it was my 'exes' cop friend. We had just broken up and I was moving out that weekend. I am sure she just wanted me harassed (I was arrested in our parking space)...due to running into a shelf she had hung in a door way (one of the reasons after moving in together that I was moving out/breaking up) nearly knocked my lower teeth out.

Anyway...that night I was broke...I was milking my drinks, free dualing piano comedy show...On my 'tapes' I was totally alert, a little tired, but blew 0.168. I had my receipt (now I do realize it's not going to be able to say if I didn't cash pay for drinks, nor show up four hours early tanked, but there were a few people that would testify otherwise...in the end it would be a waste of time in my situation).

My advice is if you drink, contact a lawyer...ask him what you can and cannot do. Then if possible never ever take a breath test if you have drank any alcohol recently.

NEVER submit to a field sobriety test. Even if stone cold sober. They are designed to fail people, and give probable cause for arrest.

ALWAYS demand a blood test if you think you may pass it. Breathalyzers aren't accurate, and that little extra time might be all you need. Plus, blood tests are done by a third party (at least here in Alaska), so you don't have to worry about the police "fixing" anything.

Yep. This is why you always insist on a blood test, even if you had "just one beer."

Why you ask why? You did it yourself. I had a 2 week old honda that got $800 worth of vandalism. Now that is a why question. You did it yourself so I do not see why you ask why.

Just get a bra that covers the front bumper. Cost = $100.

In Florida, if you refuse to take a breath test, you also lose your license for a year.

I believe you can ask for a blood test instead.

http://www.flsenate.gov/Statutes/index....gt;Ch0316->Section%201932#0316.1932

I am just not finding that part about asking for a blood test. :( Can you point me to it?
I see "The person shall be told that his or her failure to submit to any lawful test of his or her breath will result in the suspension of the person's privilege to operate a motor vehicle for a period of 1 year for a first refusal."

It mentions blood tests later in the article, IIRC.

As if it weren't implied by the term "drink and drive?"

My reading comprehension is fine.

In CA you do not need a BAC above .08 to be charged with DUI.

http://www.aaa-calif.com/corpinfo/guides/duiguide.asp
Drivers whose BAC does not exceed the presumptive BAC limits can still be convicted of DUI if other evidence shows their abilities were impaired.

Courts frequently prosecute arrestees for violating both the per se and presumptive statutes. If evidence from the BAC test is strong, it promotes conviction on the less complex per se charge; if BAC test evidence is not strong, prosecutors will still attempt to use sobriety test evidence to prove that the defendant was physically impaired, and guilty of the presumptive DUI charge.

Extremely rare. And damn near impossible if you refuse to "walk the line" in a field sobriety test.

Any good lawyer would get such a case thrown out on a first offender with a clean record.
