If a previous employer wasn't listed on your work history, is there anyway a company will find out that you used to work with that company if they do a background check on you?

There was a case recently where a guy was fired for the same thing and he sued and won. The judged deemed using the internet at work was like using any other tool such as the phone, cell, etc.

Of course this guy wasn't likely neffing on ATOT like you!

They can not pull tax records.

They can pull credit records to see what employers you may have listed.

If they are suspicious of gaps in your employment record;
They can also (if they want to) have an private investigation down by tracking down people and asking questions. (This would not usually be done unless it was a sensitive position).

My reason was a little more complicated. The company was hit by the blaster worm and the computers kept rebooting because the new system admin failed to patch the servers. They checked my browser history and blamed me for infecting the company with a "virus." Since I violated the company policy of no Internet they fired me.
 
probably not a big deal, most background checks consist of looking at county and state records of any convictions and what not. Some places like banks will also enlist the FBI and be much more careful about your background. It depends where you work and what you work with (i.e. drug dealer would not be able to work at a lab, con man in a bank etc.).

In the end its is easier to explain something before the fact than after the fact. For instance if you had listed that comapny and then made a note or whatever that they could not be contacted. You have a veriety of options of what you can tell your prospective employer (dependign on how honest you are) are the reasons he/she cannot contact that previous employer. You could say that you lost touch with the company and they probably will not remember you or that you have not yet spoken to them in regards to possibly being contacted by the prospective employer and would not want to be rude or improper.

Doing it this way effectivly puts you in a win/lose situation. If they don't find out /don't care, then whatever you are in the clear. If they DO find out they will be like "wtf" and then you will be on the defensive.

On the bright side if they didn't notice a large gap in your employment during the interview, omitting that particular job might be irrlevant in the large scheme of things. Just wait and see what happens. Make sure you have a good reason for the omission when and if they bring it up.

A background check most likely will not pull up any of your past employment history. The Background checks that I do are strictly criminal, however, I, and other employers, can easily pull credit and educational background checks if needed.

That being said, here's a caveat, and I'll use my company's application as an example:

We have 4 spots in our job history section for an applicant to indicate past job experience. We specifically ask to enter in the most recent and go back in chronological order.

In your case, say this job that you got fired from is job #2, but you "omit" it on your appliation. If we hired you and at a later time found out that you knowingly "omitted" a previous employer we would have every right to, and most likely, terminate you. Not because you didn't tell us that you got fired from a previous job, but because you knowingly LIED on your application.

Just my 2 cents...

Just to split hairs, asking them vs telling them to list their previous jobs are different, right? Wouldn't you have ground for dismissal then b/c they did not complete the application in complete and truthful manner, Especially if they endorse it saying that it is complete and accurate. (Assuming the Application has such a statement on it. ) Also, would the employer have to be an AT WIll Employer to go straight to the termination phase.
 
What type of job are you potentially going to get that is causing this question? I think your answer will depend primarily on where you might work to determin what type of "background check" they may do.

no. for me i left voluntarily but i did not want my previous company to know i went to a competitor (long story). thus I did not want my current employer to contact them. they can contact my previous-previous company.

i actually told them that
