I posted an interesting story here awhile back about some stupidity like this in my town. I see it all the time. I'm not anti-gun but I come off as anti-gun because I see so many stupid people with guns being stupid.

The only people who should be allowed to own guns are people who were raised with them from a very young age. Trying to teach someone as an adult proper handling and safety is NEVER going to work.

I'll give you an example. I used to know this moron who was raised in NY and had never handled a gun in his entire fucking life. So he decides he's going to get a handgun license and buys a revolver.

I'm over his house one day and this idjit keeps pointing his unloaded revolver at me. I try to explain to him that you never, ever do that. 'But it's unloaded' he says. I try to explain to him that you ALWAYS have to treat EVERY gun as if it's loaded ALL of the time. And if you don't understand why, then you're a manslaughter waiting to happen.

A Florida man was behind bars after police say he shot and killed his brother in a beef over a cheeseburger.

Benjamin Angus Middendorf, 25, was charged with first-degree murder in the death of his older brother Thursday.

Nicholas Middendorf, 28, was killed after being shot once in the chest, Fox 35 Orlando reported.

“We were in a fight and I grabbed a gun and I shot him. Oh my God!” Benjamin Middendorf says in a 911 call released by the St. Cloud Police Department.

“My son shot my son,” his mother says to the dispatcher during the 911 call.

“Where is your son who shot your other son?” the dispatcher asks the woman.

She replies, “Right here holding my son,” and then is overheard saying, “I hope you go to jail.”

Police responded to the 911 call around 10:30 p.m. Thursday, Fox 35 reported.

These are definitely stupid events. At first glance it sure seems like there is a lot of stupid out there, that maybe everyone out there is stupid, but then I am reminded that we have 330 million people in the US. That's a lot of room for crazy.

Assume this happens each month 10 X 12 = 120.

120/330million = 0.00003% act stupid with guns each year

Maybe this is just a fraction of the dumbies. Lets quadruple it. Still only 0.00012%

Honestly I think one of the biggest problems with society is that we put way too much weight on whether a crime is intentional or not. If we started treating accidental death the same as 1st degree murder people might start being a little more careful.

"It was an accident" shouldn't ever be valid excuse.

Criminal law is based on mens rea - evil intent. You punish the intent not the act. You can argue that fucked up but most people seem to think that's a fairer way to write and enforce laws.

You could however petition your state legislators to enact more severe penalties for unintentional death based on the degree of negligence involved. I think they already do that though. For example, driving your car into a crowd, even if accidental but grossly negligent, can often be treated as an intentional crime because of the degree of negligence.

lol. Good one! It's not that adults cannot be trained, it's that you hang out with stupid people irl. Misery loves company.

I shot guns when I was younger a few times, but wouldn't say I was raised around them. I own several guns now and have taught my boys how to shoot them and how to treat them. I've taken one to Hunter safety training and the other will go next year with my wife and the third when he's old enough. They know not to point guns at people, even if they "know" they are not loaded.

The main problem I have with it is that it's very easy to say something is an accident, even if it's not. Until we have mind-reading technology, you can't 100% prove intent, it's simply impossible.

That's true. So what courts do is imply intent from the circumstances. Someone can claim they shot their wife or husband by accident. But if the circumstances don't support that and instead imply that the act was deliberate and premeditated, they can lie all they want. A jury should, should mind you, always return a verdict for murder.
