Anyone else having trouble accessing the efi-x site or forums? I had been following the action pretty closely. Then today, the whole site seems to be slogged down.
Apple doesn't have any legal authority over them - it's simply a USB stick that happens to install Leopard, Vista, XP, and Linux. Also, they're not based in the U.S., which makes it harder for Apple to get them. I think as long as EFI-X keeps a low profile, they should be OK.
Seems to be back up for me now. And right, Apple doesn't have any legal control over the site, but I was thinking they might try to swamp it with requests to reduce it accessability.

Nah that'd be dumb, beacause it could be traced easily and it'd only be temporary (difficult to sustain an attack that large for that long). I think it's just normal traffic (well, excessive normal traffic).
There is a TON of interest in EFI-X and a huge backlog of orders. They are going to be swamped easily into next year based on their current orders.
