ebay woes

Pretty much, I am asking what I can do about this:

I buy a video card off ebay from a buy it now store, and wait about a week after payment for the item. I have emailed the seller a few times for when he shipped it, and how it was shipped, etc. At the week point, a couple other buyers of the same item email me asking if I have heard anything from the guy, because they haven't either. At the two week point with no contact, I submit a paypal buyer complaint, and the guy emails me back within an hour asking why I did this. He tells me I haven't sent him any email, and that it's my fault. He doesn't respond to paypal's investigation, and after the allotted time, I get this email from paypal:

"We have determined that the seller is at fault in this matter but regret to
inform you that we were unable to recover any funds from the seller's
account. As stated in the PayPal User Agreement, recovery of funds
associated with a Buyer Complaint cannot be guaranteed."

I know I can file something through ebay to get $200 - $25 deductible, but on a $360 purchase, that is only half the money. He won't give me a refund by check or money order, as he says his paypal account is frozen, but it still reflects $360 for a chargeback.

What now?

Thanks for any insight you may have.

ugh, i really hate when sh!t like this happens. Granted it's never happened to me, but I always feel for the people who lose out on things like this.

Sometimes I wish those scammers would be in my room so I could punch them in the face really hard. Or swing a bat into their face, either or.

So.... anyone live in Kentucky?
Also, when I did the chargeback, he said he would have to stop shipment on the item.... so he couldn't provide me with a tracking number, but he could stop shipment (never heard of being able to stop a shipment, but whatever).
