eBay reserve question.

Let's say you win an auction (say, for a car), but the reserve has not been met. If the seller then decides to sell the item at the price of the winning bid, are you obligated to buy it?

Seems to me that you would be, since a bid is a legally binding contract - and reserve being met or not, you still placed that bid, thus mandating your requirement to fulfill it.

no you are not. ebay counts that as not being sold. they can do a "second chance offer" to you but they cant make you buy it.

In my post above, I was referring to a bid that did not meet the reserve price, and I wanted to bid on something else.

I was highest bidder on an auction that didn't meet reserve. I don't know what the reserve was, but my bid was certainly what I was willing to pay.

The reserve wasn't met, so there's no obligation to anyone.

However, I emailed the seller and pointed out to him that I was interested in the item if he was interested to sell. He sent me a second chance offer for the price that the auction ended at. At that point, it was up to me to accept or decline.

This all happened last month.
