Ebay problem....

I purchased a Planar lcd panel from a person with good rating (43). I sent the money via paypal and he sent the lcd via UPS. I am supposed to receive the lcd today but I found out that the package was damaged en route. Now, I dont know if its UPS's fault or the seller(maybe he didnt package properly?), but I am stuck here with $640 less. I emailed the seller just now and am waiting for a reply. I called UPS and they said that they are sending the package back to the shipper. Ahh!! what should I do!

I am wondering if its possible to claim a fraud in worst scenario...

Any package shipped via UPS carries a minimum amount of insurance. Hopefully the seller insured the package properly, and it was packed well. How "damaged" was the package?

Fraud is a pretty serious claim. You'd better be damned sure you can prove that he willfully tried to screw you before you start throwing that around. Unfortunately, stuff like this happens. See if you can work it out with him or UPS or both.

Odds are the mishandlers at UPS (Yes every shipper has some guys who have no respect for the stuff being shipped) put your lcd's box under some 150lb item or did the 20ft toss into the truck. If the seller didn't insure it fully he/she is going to wish they did as only a fool ships stuff like that without full insurance. Most likely the seller put full insurance on it and once ups verifies that it was their fault the seller will probably refund your money to you.

i would say that since you never recieved the package to begin with then it is all on the seller to send a new one or to fully refund your money.
