Ebay Problem

Okay.
I bought a phone on ebay.
It's listed as a Brand New Black w810i. Cool.
Get the phone.
Pieces are falling off the phone because the adhesive is not strong. Phone does not seem to be constructed well.
Contact seller. Seller tells me to pay to return phone to them, and they will send me another one. I don't want to pay to send back this phone.
I notice on the box the phone is supposed to be "Frosty White."
Check the IMEI number on both the phone and the box. They are the same. The phone should be white.
So, I was sold a phone that is not only not brand new, I'm pretty sure it's had it's housing changed to black.

I want a full refund, as these people are obviously shady. They say no refund.
I paid with PayPal.
Should I just file a complaint?
What can I expect with a paypal complaint?

Tell the seller that you are going to open a dispute with paypal if you do not get a refund or the phone you want. If that doesn't work file a complaint asap. If you paid with a CC dispute the charges. Start saving all messages between the seller and you.

I dont want another phone from these people. I just want to get my money back and not deal with them. The only reason I know this one is not supposed to be black is because they were dumb enough to leave the sticker on the box.
Will that make a difference?

I would assume that because of what you have said the item falls under the category of "not as described." Opening a dispute will probably be your best bet since the seller doesn't want to refund your money.

This is why when I use ebay pay with a CC so that way I can have them backing me as well.
