Ebay problem

Summary- bought a sprint 8100 phone. came to me damaged. sent back. guy said he would fix it. put some bolt in it which looked like sh1t, so i said give me a refund. he then says he has a 5300 (much nicer phone) he'll give me. Through about 30 emails and about 4 months, he hasn't given anything up. Ebay pretty much no help. Has anyone else gone through something like this/ any suggestions?

Thanks a bunch.

He did, but it looks terrible. Now the problem is that he will not contact me, he has gotten lots of complaints and often sends me psychotic letters about his problems...

Looks like you're screwed, did you use paypal? You might be abel to get paypal to get the money back for you.

I have been in this situation before, but the question is do I contact the cops?

Doesn't hurt, but they will not do anything. Since he hasn't done anything in 4 months, hope for the worst and eat the loss. Who cares how your phone looks? I have a V60i that survived the washer and dryer and has the permanent detergent stains to show for it 🙂

How to figure that ESN number used?

He eventually cleared the ESN and claimed some sort of mixup, but the phone was in perfect condition, and I ended up keeping it. It did have 20 minutes of use though.
