eBay Problem: Too soon to get medievil?

I did "buy it now" on a cheap bike on the 24th and paid immediately. I have requested shipping confirmation numerous times and have only gotten one response (about a week ago) that said, "I will have it for you tomorrow".

I am about to hit send on the following e-mail:

Ken,

I won this auction on the 24th and paid for it on the 26th. That was a week ago. Since then I have made numerous requests for confirmation of shipping. I received the response below from you almost a week ago, but you never followed up with the information. You have not responded to any of my e-mails since then.

I would be happy to learn that the bike is on its way and that this is a simple misunderstanding, but the fact that you do not have the good grace to respond to my e-mails makes me concerned. If I do not hear from you or receive the bike by tomorrow, I will leave a negative feedback and have paypal remove the funds from your account on suspicion of fraud.

You only paid a week ago. It is way too soon to start mentioning fraud and paypal intervention.

Be patient and wait a while longer (at least a week). He has no obligation to email you any shipping confirmation, so you shouldn't get worked up that he hasn't.

"I mailed it yesterday" is sufficient. How hard is it to hit reply and type that?
 
start the process with paypal, if its an error it can get corrected...that way paypal will open a claim and send him an email to...then you will see action

Whether or not it is hard doesn't matter. The contract that both of you entered into does not require him to do so.
 
Err, paying 2 days after the close of an auction is NOT paying "immediately". Further, if you paid on the 26th then the soonest it could have been sent is the 27th, which is too soon to jump to any conclusion about fraud.
 
And this raises the question of appropriate feedback. In my mind, not replying to e-mails and not saying when the item shipped is poor eBay practice. Does that warrant negative feedback? Perhaps neutral is more appropriate...

I paid about 1 minute after hitting buy it now on the 24th. I did not wait two days as stated in the unsent e-mail. That was a mistake.

not communicating shipping/tracking details does not warrant a positive feedback, imo.

EDIT: neither does a general lack of communication.
 
If you pay with a CC, maybe he waits for it to clear on his end? BTW, a week is nothing, wait for 2 weeks before you do anything. BTW, is there anywhere in the auction said that he has to provide you with shipping confirmation? If not, just wait it out for 2 week.

If it is arrived within 2 weeks and the products are as described, then it is a positive feedbacks.

I sent this somewhat toned down e-mail today:

I did "buy it now" on your auction because I was interested in getting
a bike quickly. It has now been 2 weeks since I won the auction and a
week and a half since you promised to provided shipping
info "tomorrow". In that time I have not heard from you other than
the aforementioned promise.

If I don't hear from you or receive a bike by tomorrow, I am going to
leave negative feedback and have paypal return the funds to my account.

Get rid of "on suspicion of fraud" and you have a winnar.
There's no reason for the fraud comment. It's inflammatory and wholly innacurate.

The "good grace" comment is also uncalled for. There may be perfectly good reason why he hasn't responded and none of them have anything to do with grace.
