eBay/Paypal dispute

Need ATOT to help me a little bit.

1. Bought a battery off eBay. It got shipped out from Hong Kong, arrived DOA. I contacted the seller and he's agreed to process a replacement for me if I shipped it back to him.
2. Because it took 2 weeks for the DOA battery to arrive here, I asked him nicely to "extend a favor" and ship me a replacement first. The seller agreed (on a Saturday, China time) to send me a replacement on Monday and get me a tracking number. He also agreed that I could send the old defective battery back to him when I get the replacement.
3. Came Tuesday afternoon (US time), no response from him. I fired an email and Wednesday morning (US time, so evening for him) he provided me the tracking number for the ORIGINAL defective battery - a sign that he never shipped out a replacement.
4. To do him a favor, I let him know that I shipped out the defective battery back to China.
5. I wrote him back letting him know that he gave me the wrong tracking number. He apologized and promised to send out the replacement Thursday morning (their time, so Wednesday night for me) and get me a tracking number right away. This was Wednesday morning for me.
6. It's now Thursday night and I've gotten no response.

I don't think the seller is being very responsive and can't hold up his end of the bargain. This is just taking way too much time and I'm thinking about writing him for the last time to ask about this and just maybe cut my losses, leave him a neutral feedback and just going through Paypal for a dispute or CC for chargeback...can ATOT shine a light on this for me?

Let him know you will cancel the charge and not accept the item if he doesn't send it asap.

Credit card 100%. Paypal could give a shit about people period. I do credit card disputes for a living.... they try to fight EVERYTHING. They come back with fake tracking #s or anything they can think of.

This is absolutely correct. Modern day, do not even bother filing a Paypal dispute. Not only will they tie up your funds for over a month in the process, but nowadays they've taken a great liking to deciding they cannot determine who was right, and simply keeping the money for themselves and fucking BOTH parties involved.

Screw that noise. If I'm forced to deal with a Paypal transaction I will, but I'd be damned if I trust them to mediate anything logically. Just call your credit card company and file a dispute.

Some people have had pretty good success with this particular seller on the Lenovo forum, so going with him seemed like a good idea at the time.

I order things from HK/China every so often. The prices are usually substantially cheaper and I usually get everything in proper order. I just ordered something from Singapore through ebay, in fact. But when I do this, I inherently acknowledge that if the item is busted and the seller doesn't care to fix it, I'm screwed. Shipping an item back is out of the question for small ticket items, since the shipping itself is cost prohibitive. For big ticket items, I stick with US transactions.

Having said that, I'm not sure if Paypal can help in these instances. The transaction was international and package tracking is haphazard. If you can go directly to your CC, I'd do that. I'm not sure how Paypal will react to it though.

Anyway... you'll more than likely do a dispute through paycrap only to find out that the seller has no funds available to recover in his account. Screwed.

Next step, chargeback through the credit card company. Yay, you get your money back... at the expense of being shit all over on by paycrap. They absolutely HATE chargebacks, in fact it's against their TOS last I knew (you agree to take it up the ass their way). Your paycrap account will likely get closed, so make sure you don't have any money in it before you file a chargeback. And don't expect to be able to use paycrap ever again.
