eBay dillema. What should I do?

I list and sell an item on eBay last week. My auction terms explicitly state that I only accept PP and that a payment must be received within 24 hours after auction ends.

Buyer A bids and wins. Buyer A is an eBay power seller with over 14000 feedback. I send an invoice immediately after auction ends. 24 hours go by and no response. I send a reminder telling them that their payment was due and that if I don't hear from them in 24 hours I will relist. Another 24 hours goes by with no response.

I relist the item which was won by Buyer B. Buyer B has a decent feedback of 35 and has been around for couple of years. I send an invoice and receive a PayPal notice that I was sent an e-check which won't clear for another 5 days or so. That was this Saturday.

This morning I receive an email from PP informing me of the payment from Buyer A. I am in a bind now. Looks like no matter who gets an item or refund I'm faced with an unpleasant exchange/feedback.


I would like to hear from some experienced eBayer here. What would you do in my situation. I am adding a poll as well.

Buyer A didn't meet the terms of the auction, which surprises me, with his history. Refund, and tough luck.

Unless Buyer B falls thru.

Go with A here. You have a leg to stand on with the sending of an E-Check. Just let them know ASAP incase they need the item. But A should get the Item. Don't issue a refund until the check clears.

24 hours after auction ends and PP only? Sounds like the terms for an item that needs to sell fast... like Xbox 360 :)

24 hours for payment is not very reasonable. He could have been out of town, in the hospital, internet down, etc. What's the rush?

Exactly. My terms are listed in bold red letters. My auction opens with a big lettered warning telling everyone to read and agree to terms BEFORE bidding.

People on eBay piss me off, I sent over $900 five days ago. I still haven't received an email from the seller.
He claimed it would go out within 1 hour of paypal confirmation guaranteed and I still haven't heard from this d1ck head.
Did I mention this item was supposed to FedEx Overnight?

i think you should have been more reasonable and flexible on your 24 hour requirement as this was a holiday weekend where people can be away and off their computers (I know, what a concept!). Anyway, you are stuck now. Refund buyer A for failing your requirement but do brace for a negative.
In the future, you may consider a buy-it-now with immediate payment required through pp.

I don't believe you can file against A since he(she?) didn't violate eBay's policies. Only your own. I think you should swallow the fees (since you would get hit with them anyway because you are selling the item to B).

BIT with immediate payment was offered. My terms are not unreasonable, if you have time to bid you have time to read the terms. Don't like my terms, don't bid. Isn't that simple enough?

I always time my auctions so that I'm able to ship within one day of the payment.

I'd eat the fees and let bygones be bygones, unless it was a $1000+ item, then I'd start filing some reports.

You should have waited a bit longer before relisting or else you wouldn't have run into all this trouble.

There is no reason someone can't pay with PP within 24 hours unless there is an emergency. At the very least they should give me courtesy and reply to my emails if they have difficulty meeting deadlines. Again, they should be well aware before placing a bid.

That wouldn't be ethical on my side. I am not out to rip anyone off or give someone an impression that I am up to something fishy.
