Lastnight I won an auction on Ebay using Buy It Now and had planned to pay for it tonight. It was a very nice deal on a set of Klipsch F-3s. I was in the process of paying for it when I recieved this e-mail:

Dear brian,

I was informed that there was an error in this listing and that we have to actually re-list this item for our clients. Unfortunately, there was a lack of communication and it was not supposed to be set up as a Buy It Now auction. We will have to at this time cancel this order, however, it will be re-listed within the next few days. I do sincerely apologize about this mix up and hope that you will understand. Thank you.


Now is it just me or this just seem wrong? I don't how it's supposed to work but I thought if you won an auction a seller was supposed to sell you said item. Thats like setting a no-reserve auction and then renigging on it because it didn't sell for the price you wanted. What should I do, try and fight it or forget it? Any help would be great. If I am totally off-base please let me know.

its obvious, they lost money or didn't get enough of a profit. Nothing you really can do, leave a neg and move on.

In the end nothing will happen, Ebay won't care, leave negative feedback, but beware you may receive some in retaliation (which is against Ebay rules).

you could file a non preforming seller alert. Ebay will not do anything about this unless it happens with the same seller on a regular basis.
be prepared to get bad feedback if you do this.

Bottom line thou... is that the item is the property of the seller and then can do whatever they want with it... until money changes hands, ebay really wont give a toss.

I knew I already should have paid for it sooner but I didn't have a CC listed with Paypal. :( I guess it also doesn't bode well that I have 0 feedback. If I take a negative I'll never be able to use my acount.

No, nothing in the ad says about paying that fast (immediate payment). Ebay says to contact each other within 72 hours, so you?re good there.

Technically you have a binding contract and the seller, according to civil law must perform that contract. In the real world... you just move on.

I'd just fill out whatever ebay form there is for when the seller refuses to sell to the winner. Leave some negative feedback, and then forget about it because like other have said, most likely nothing will happen.

I recommend that you not leave negative feedback unless you want to go ahead and dump the user account you currently have. After looking over the seller's feedback I get the feeling that if you neg him he will neg you back. A neg for him with all the feedback he has won't hurt him a bit. Don't kid yourself otherwise.

You on the otherhand don't have any feedback so a neg would mean a lot more to you.

Basically you have nothing to gain by leaving him a neg but you do have something to lose. Seems like a clear choice to me. Suck it up and move on.

I've already thought about this. While retaliation negatives are against "ebay policy" I doubt they'd do anything about it so I guess I'll just keep searching for speakers else where. That said my dad wants me to push it, he doesn't care what it takes. :confused:

Email eBay and complain. The seller's obviously trying to con you out of a good deal.

If you haven't replied to that email yet I would pay and then 'read' it...
It's not 'your fault' if you didn't get the email in time...!!!
Then make a fuss with the seller because you have already 'paid' for it...
If he refuses to send item raise hell with ebay until seller makes some kind of agreement...
...
That being said I wouldn't do this myself...
But I would love to see what happens if you do...!!!
I see great updates in the future...
Heck we could turn this into a full fledged movie...!!!

I repectully disagree. It's about the right choice, and doing a service to the Ebay community. There is already enough looking the other way going on to make it difficult to get a true sense of the person you are dealing with. Ebay recognizes that, hence their policy and position against negative feedback. If another buyer or buyers had similar experiences and posted it, you may have thought twice about bidding. I wonder how many people that came before you just blew it off, leaving you in the situation that you are in.

Best you can do is start another eBay account, win one of their other auctions and leave a negative

In other words he should take one for the team? ;)

Just to clarify, I think he should take whatever steps are available to pressure the seller into completing the transaction.

If he leaves a neg though all that will happen is he will be negged back which will ruin his account. I would never allow someone whose only feedback is a negative bid on one of my auctions.

On the other hand if he negs the seller it won't do any good. The seller will reply to the neg with a BS excuse and anyone that reads it will see a neg that was left by a nobody with no feedback and a reasonable sounding excuse by a "well established" power seller.
