DUI on private property

I found this quote at one Police department website: "Remember, DUI laws apply not only to the operation of any motorized vehicle within the city. Drinking and driving laws apply to the whole state - private property or not.

That means if you're riding drunk in an ATV in your private land, then you can still get arrested for DUI. I didn't realize that.

well then myself and several friends are guilty of DUI one 4th of July.

that poor poor John Deere Gator.

got stuck in a women's lawn doing a u-turn last year during rainy season, muddy as hell, I was stupid.

they checked me for intoxication. good thing I wasn't messed up that night. after three hours of sleep that night, I had to wake up in the morning and go fix her (trailer trash) lawn. it's funny 'cuz I am still alive.

Supposedly you can get a BUI here, but I think it's ridiculous. The only life I'm endangering is my own, and I haven't ever had an accident while riding my bike intoxicated in at least 4 years of doing so (forget walking back from parties :p).

if that were true in arizona, the cops wouldnt have watched a guy i used to work with slam his van into 4 parked cars in a parking lot in downtown tempe. they waited until his tire hit the sidewalk (he was trying to move his van to a clear spot, was double parked lol) and arrested him. he said they cited him for the accidents, but only because they went inside and found the people who owned the vehicles and asked if they wanted to press charges. i know ive gotten out of a few tickets for messing around on one of my faster motorcycles because i was in a parking lot when the cops saw me.

I'm riding my bike with training wheels inside of my house under the influence, can i get arrested for that? Even if i wear a helmet and wrist/knee pads?

I think my uncle got a ticket for riding his bike while drunk... he crashed it and ended up in the hospital.

He was riding his bike because his license was taken away long ago due to too many DUIs.

My father-in-law got a DUI for driving his farm tractor on his property. Of course he had an accident, he knocked a dead tree down with the plow, and it fell on top of him. He basically was incapacitated and the tractor kept going with him on it until it hit a tree. My mother in law found him knocked out and tractor still spinning the tires. She called 911 and they came out and the police hauled him off down to the station. He went home later that night, but the next day he went to the hospital for a punctured lung and I forget what else was wrong with him. The police later dropped the DUI charge.

I vaguely recall a reality show on TV where in one of the characters was taken to jail because he was too drunk. They did not arrest him. They just put him in the cell, so he could sleep it off.

A: Again, the answer depends of several issues. Some states restrict the offense to public property but most states make it unlawful to be DUI on private property. Remember, private property is generally defined as that property on which the general public has no right of ingress or egress (coming in or going out). So, even though your local market's parking lot is owned by them, it would be deemed public property since the public has the right to enter and leave as they wish. Even if DUI is a crime on private property, in at least on estate, Florida, the law does not seem to permit an arrest for DUI on private property. Yes, the law is complex.
