they don't know it is, you don't understand an alcoholic mind. how do you not know if he was in a blackout? ive known tons of alcoholics and they do totally dangerous stuff that they would NEVER EVER do when sober. and yes its a condition.

and im not saying he doesnt deserve serious jail time, he does...but everyone who says "just kill them" are taking it too far.

I can never understand why people would argue for softer punishments for those that literally can not control their actions due to some combination of physical and mental imbalance. You can cure learned misbehavior through rehabilitation, potentially. You can't cure diseases like this. Execution insures that their inferior seed is not spread.

That wasn't really the point of my post. What I question is the logic of...

Individual with no biological predilection towards alcoholism kills while DUI -> Burn at the stake!

Individual with hereditary alcoholism kills while DUI -> Feel pity, he was born with it!

It's the same thing for pedophiles or the mentally deficient. If you want to reduce crimes committed by them, it makes more sense to go after the ones of higher risk.

Yea, you don't cure the drunk drivers by killing the ones who hit the 1/10,000 odds wheel of killing someone while driving drunk. That is really a silly notion to punish the ones who hit the probability strike of getting into an accident while driving drunk. The intention of murder is hard to justify here, because they certainly do not intend to injure kill, they are impaired.

We need to address the problem before they get in the car in order to push down the odds of folks being injured/killed from Drunk Drivers. How many drunk drivers are repeat offenders?, I though I recall seeing it was a majority.

Anyone arrested for drunk driving once gets to do a breath test to start their car for 7 years and gets to do volunteer twice a month for 3 years and 4x a year for the next 7.

I remember hearing about this case in the past, but don't remember all the facts.

Even so, a person shouldn't have carte blanche due to 'good intentions'. In this specific case it's really on the fence. Torti thought Van Horn's life was in danger, but as a result of her deed Van Horn is now paralyzed. Without doing too much research it sounds like Van Horn's life was not actually in any danger.

The fact that a case on the border like this is allowed to be heard isn't much of an indictment of the treatment of good Samaritans. In the end, the person could still be found not liable.

Bull fucking shit. Just killing them isn't half what they deserve. Torture them endlessly with home movies of their victims. Kill them slowly, and painfully. Let every person affected by their selfish carelessness get a turn on em with a spiked board and some acid. Only then should a bullet end their worthless, miserable existence.

It's a good read:

During the evening of October 31, 2004, plaintiff, Torti, and Jonelle Freed were relaxing at Torti’s home where plaintiff and Torti both smoked some marijuana. After defendants Anthony Glen Watson and Dion Ofoegbu arrived, they all went to a bar at around 10:00 p.m., where they consumed several drinks. They remained at the bar until about 1:30 a.m., at which point they left.

Plaintiff and Freed rode in a vehicle driven by Watson; Torti rode in a vehicle driven by Ofoegbu. Watson lost control of his vehicle and crashed into a curb and light pole at about 45 miles per hour, knocking a light pole over and causing the vehicle’s front air bags to deploy.

Didn't you hear? Schizophrenia is a DISEASE. This is a FACT. That's why we should not forcibly institutionalize people after they turn crazy and shoot at the white house. They have no control over their thoughts, so it's wrong for us to try to prevent them from murdering the president. Everyone knows this.

You're joking, right? Those things are ineffective (way too may ways to circumvent them) and punished tens of millions of law-abiding people.

In some ways it is, but I'd never call alcoholism a disease the same way that cancer is. Have you ever known a hardcore drunk? I have (and even lived with one) and let me tell you, there are few people more selfish and dishonest than serious alcoholics. I've also known people who I'd classify as functional alcoholics who still know enough not to drink and then drive.

Some people are more prone to alcoholism because it helps them function in certain ways. It's similar to how some people love smoking while others do not. Some people are naturally drawn to caffeine while others are not. Some people are drawn to use stimulant drugs like cocaine. Other people are drawn to sedatives and pain killers like heroin. I would be willing to say that it is a disease and that's why it requires special treatment. Drinking and driving is definitely not proper treatment.

As with any drug seeking behavior, it should be treated with drugs. Our society is a total mess in this regard. We acknowledge that some people are very high risk of drug addiction, but it's taboo to try to prevent it. If you say you're addicted to cocaine, people hiss at you. If you start taking antidepressants and it completely stops your cocaine addiction, people still judge because you're on antidepressants. It's like you can't possibly win. Drink alcohol and people hate you. Stop drinking and start taking medication and people still hate you. Alcoholism wouldn't be such a big problem in our society if we encouraged people to get treatment instead of just hating on them.

But that's just alcoholism. The driving part is why the guy needs to be executed.

Alcoholism is a disease, we all agree on that. Drunk driving isn't. Drunk drivers who end up killing someone should be killed, no questions asked. If someone has a disease that leads to blindness, guess what, they shouldn't be driving a damn car either. Disease isn't an excuse to do something you shouldn't, especially if it can get someone else hurt or worse, killed.

I bet this isn't the drivers first offense. People that are drunk by noon are pretty common with alcoholics. They drink until they pass out at night and then as soon as they wake up reach for the bottle again. I knew someone that was so bad he would drink rubbing alcohol, seabreeze, anything with alcohol of any kind.

Should be dead now.
If your liver is destroyed Isopropyl alcohol is lethal.

I had an ex-girlfriend who self-medicated for depression with booze and turned into a raging alcoholic. At her worst she would down a 750ml bottle of vodka (she weighed maybe 110lbs at this point) in under 10 minutes. Worst BAC level she ever had in the ER was .46 (and she was still semi-conscious at that point.)
