SANTA ANA, Calif. (AP)—A jury convicted a construction worker of murder Monday for a drunken-driving crash that killed promising Los Angeles Angels rookie pitcher Nick Adenhart(notes) and two of his friends.

It was the second DUI conviction for Andrew Gallo, 23, who held white rosary beads and occasionally looked up at jurors as they returned their verdicts.

As he was led away in handcuffs, Gallo glanced over his shoulder at sobbing relatives of the victims gathered in the Orange County courtroom.

“What this case has shown is that the accelerator, the gas pedal on an automobile in the wrong hands is as dangerous as the trigger on a gun,” Nigel Pearson, the father of 25-year-old victim Henry Pearson, said outside court. “And in the wrong hands, it can devastate the lives of many, many people.”

Gallo was convicted on three counts of second-degree murder and single counts of drunken driving, hit-and-run driving, and driving under the influence of alcohol and causing great bodily injury.

He faces 50 years to life in state prison at his scheduled sentencing on Dec. 10.

Hard to argue. The murderer:

1) Was convicted of DUI and signed a document saying he understood that if he drove drunk and killed someone, it would be murder. Family, friends, and the court told him the same.
2) After that conviction, he drove around town binge drinking.
3) Ran a red light, killing Henry Pearson (25), Nick Adenhart (22), and Courtney Stewart (20) with his car.

I wonder why deliberations took so long. I guess sending someone to jail for life over something that isn't intentional homicide is difficult, but good decision to put the guy away for good.

One of those girls went to my college.

Shitty times. That guy was a murderer, plain and simple.

Regular construction dude gets 50 years to life for killing 3 people forDUI. And, the cop is going to jail and likely get pay for "injury at work" for killing 2 girls while excessively & dangerously speeding 200+ km/h while texting on his phone.

America, the land of free and just.

Yet when a cop texts while driving triple digit speeds and kills two girls head on he only gets probation.

Its bullshit that they are going around the "malice" component of "murder."


If you think vehicular homicide/gross negligent homicide penalities aren't strong enough, then increase them. No reason to call something "murder" when it does not fit the legal definition.

That being said, with this guy's prior, he has no business ever being a free man again.

Funny how that works kill a family of 4 while drunk get 4 years if that. Kill someone famous and get the book tossed at you. :(

Actually the reason he is being charged with that is because of the DA here in OC, not because of who it was.

But consider: Gallo was an adult with a prior DUI. Among the 11 persons the Orange County District Attorney's Office has charged with vehicular murder in the last two years is a minor with no priors. That jury took just four hours to convict.

what he did was bad but it wasnt murder. murder is what johannes meserle did, shooting an unarmed man in the back
