So a friend of mine (we'll call him Jeff) was driving with one of his buddies (Mark) the other day and got pulled over. Anticipating being searched, Jeff hands his piece and about an eighth of weed to Mark and tells him to "do something with it." Mark places the items under his seat.
Jeff gets searched and they don't find anything, and then they ask Mark to step out of the car. They don't search Mark, but they do search the car and find the stuff under the seat. The police handcuff and arrest Mark for possession and let Jeff go with a warning for license plate light.
Jeff now is wondering what he should do. His friend is being charged with possession of marijuana/paraphernelia that was not his. Mark's lawyer is asking Jeff to write a letter saying that the illegal objects were his, and not his client's.
Anyone have any idea how this would work out?
edit: This is in Indiana
edit 2: When the police found the stuff, neither Mark nor Jeff claimed it...so they proceeded to handcuff Mark since it was under his seat. Jeff said something to the effect of "Well if that's what you're going to do, I'll claim it then," but they went ahead and arrested Mark anyway.
edit 3: I guess I'm looking for a legal perspective here. Obviously, Jeff should, as a friend, fess up. But couldn't they both end up with charges that way? And where does "writing a letter to the court," as Marks' lawyer requested Jeff to do, put him legally?
