I have a copy of Fallout 3 that I bought a while back and never got more than a few hours into. I went to pop it back in today and the disc is pretty much unusable. It shows up as recognized from the dashboard, but it wont get past the opening credits before stalling out and I can't get it to install to the hard drive.

I noticed that its available as a download from Xbox Live for $29.99 but I'd rather not pay for it again. My question is if there is a way to get like a code or something that will allow me to download it without buying it again if I can prove ownership to Bethesda or Microsoft or whatever? Does anyone know if this is possible?

The best you can do is contacting the publisher to see if they have some kind of replacement scheme where you can swap your disc via mail. Microsoft Game Studio games have a system like this, however they charge you $20 for the trouble.
 
Another suggestion - if you have a friend that has the game, you could try installing his copy to the HD. Your copy may have enough life left to pass the initial disc check before the game runs off the hard drive.

Agreed. Or rent the game from a local video store or something, install it, then use your copy to pass the disc check (as long as the Xbox detects the disc ok, that's all it needs and the rest will run off the HDD).
