Domain Name Stolen, Any way to get it back?

Someone I know has had the website domain name of their company taken by a third party because they had a payment misunderstanding with their hosting company, telus, who is, perhaps as some of you have heard, currently a mess.

Is there any way to take back the name? They would prefer to avoid a lawsuit if at all possible.

Yeah definitely get a lawyer ASAP - leaving legal action too long could also jeopardize recovering the domain. Going into the dispute process will at least put the domain on-ice until resolved.

(While they're at it they should sue the a$$ of Telus if they're at fault for damage to business image and loss of business.)

Telus must have disclosures that protect them in such situations. Thus getting Legal advice might be your only recourse.

wow. possibly, you are screwed. Your friend wasn't the owner of washpost.com was he? lol


its gonna be more expensive then $35 a year this time. LAWYER FEES!

To make it clear.

Some of the inexpensive Hosting Company offer Domain names for very low price.

The trick is that you do not own the domain they own it and you can use it s long as you pay.

Usually this "Trick" saves you $10 or a little more per year.

If you actually own the domain and you forgot to pay you might lose it too. But the process of losing it is long. The domain will be put in the market many months after you "Forgot" to pay, and not immediately.

In other word if you already mange to get the www.my-precious- name.com Do Not be cheap about it.

Jack the process isnt long. once your domain name expires, its fair game for anyone to snatch up. its a matter of hours, if its a domain name someone wants. not months.

The last time I updaded my self, I had few big threads about it. Could be that changed.

It was a while ago. I will try to find the story and get back to the thread.

Edit: Well big changes since last time I look at it.

ICANN indicates that people might lose their domains because of mistakes, or failing to be notified about payment, but the recouping process shifted from being consumer oriented to be Business oriented.

It goes back to my first Post above. If Telus has the right disclosures on thier site there is nothing too much you can do about it.

The more I read the ICANN Rules the more it become apparent that without legal advice there is a little chance to recoup.

You know, i just re-read yoru post.

We are kind of talkign about 2 different things. I was talking about registring it in my name. You were talking about going through a 3rd party that buys the domain name, and then you buy or 'rent' from them. I know nothing about the latter.


However if it is the former, once it expires it is fair game for all. I had 2 domains I let go. Then a week later I decided to check on them, and they were gone already.

netsol.com now has a waiting list type thing you can jump on to grab a domain as soon as it is available.
