DOH! This is what happens when you forget to take the trash out!

So last week a kid from down the hall came over while my roomie and myself were enjoying Boondock Saints. With him was a 6er of bud light. Thought nothing of it at the time, my school isn't exactly the most sober campus around. He finished a few bottles off and tossed them into the garbage can, once again, I thought nothing of this and was actually happy that he didn't just leave them all over the room. The next day comes along (wednesday, 12th) we, roomie and myself, decide to head back home for the day (we didn't have class and the mound of dirty laundry was getting out of control 😛) so we pack up and leave, that night was room checks (basically the RD comes in and looks around to make sure we arn't destroying our room) we knew about this in advance. Since we really didn't have anything to hide we decided to let the RD do her thing while we were at home doing ours... Fast-forward to yesterday (tuesday, 18th) I go to check my mail and in it I see an alcohol violation, written in my name, turns out the RD dug through the garbage in the can and found the empty bottles that the neighbor has left behind. This by itself is no big deal, it's a first violation so a $100 fine and $50 of that is refunded at the end of the year if you don't get a second violation... So I go back to the dorm, show my roommate, we go show the kid down the hall, his reaction was pretty much disbeliefe, but after a few moments said that he would pay the fine, all that happened around noon. At 3pm my roomie went to his lab and on the way there stoped to check his mail, he too found the same violation, written for the same bottles, by the same RD... you get the idea. After he got back we went back down the hall and showed the kid who had left his bottles behind, this time he didn't even know what to say... fast-forward to right now... I'm about 10min away from calling the studing life center (this is the office that handles these types of situations) and asking them what the deal is with trying to double dip us.

my questions:
1. Do you think it is unreasonable of me to ask the person in charge there to drop one of the violations, after all, it was for the same thing.
2. Do you think it is unreasonable of me to ask the guy down the hall to tell them that they are his bottles and he will take the first offence violation and pay said fines.

I honestly dont have a problem with the money, it's the fact that if I get written up one more time, the school will make me attend a substance class, even though the first violation I really didn't have anything to do with.


Cliff Notes version of story above
tues - 2.11 - buddy from down the hall comes over with beer, we watch movie, he drinks his brew, leaves empty bottles behind in trash recipticle
wed - 2.12 - my roomie and i go home for the day, forgetting about empty bottles that were left behind
wed - 2.12 - 8pm - RD (resident director of my dorm) starts room checks, see's emptys, writes violations to both me and my roommate in the amount of $100/each, note: this is for the exact same thing
tues - 2.18 - we receive violations in mail, present them to the guy down the hall, he is in shock, earlier he said that he would foot the bill for one
wed - 2.19 - getting ready to call student life center, see questions above.



update 1
just got off the phone with the student life office and the housing office. the man that i spoke with said that all we (roomie and myself) have to do is write a statement saying that we were not present durning the time of inspection and why we believe that we should not have these violations, then bring the statements to them, along with the copy of the origional violation and they will start and 'appeal process'... i'm sure that translates into 'the GD kids want to fight it and we don't want to f*** with it so we'll give it to em this time process'.

Not unreasonable, but since the bottles were in your room I doubt they'll give him the violation.

Not unreasonable, but since the bottles were in your room I doubt they'll give him the violation.

thats pretty much what I am thinking. Since he already agreed to pay for one, I think I will just try to get them to make one violation out of the deal, I'll probably have to say something to how they were all my bottles, ect... Then have the guy down the hall pay.
 
I'd try to get out of this if I were you. I'm sure your school code says no drinking in the room, but they can't prove you were drinking. I remember from college that if someone over the age of 21 came in your room and drank, that was allowed. You could tell them you found the bottles outside your room, and you just threw them in your trash. You could saw you were planning to recycle them. Also, if you want to try to get out of one of the tickets, tell them your buddy was at his girlfriend's house, hadn't been to the dorm for a while, and didn't have anything to do with the drinking/bottles. Good luck fighting "the man".

Honestly, I gave that route quite a bit of thought, but I figured that if I were to call in and start trying to yap my way out of it with lies they would come back with:
"BUhahahaha!!! We have our report, thats all we need!"

I was just going to tell them that there wasen't a single empty container in the trash can, and since we wern't there at the time of inspection who knows what in the world she was doing in our room. They would probably come back with something like "We trust that our RD's, blah blah blah, don't lie, blah blah blah, too late now, blah blah blah, do the right thing, blah blah blah" to which i would've said "Well... unless you have actual proof that these 'cans' were in our garbage, I'm not paying" ... then it would've gotten messy and by making a big stink out of it we probably would've gotten off, in the process we would've made ourselves look like more of a jacka$$ then we already do.... So I just decided on the honest route.
 
The kid should pay, you should contest the double fine, and argue with the RA that some jackass left his empties in your room and you shouldn't be held responsible.

we got a new RD at semester break... so no. if the old RD was still here i wouldn't be making this thread 😉
