doesn't the whole idea of bars/pubs go against legality?

If you have to walk more than 20 feet to said public transportation, they could still nail you for public intoxication.

And nowadays many busses will NOT take obviously drunk people onboard as passengers. Also most of them dont run when bars close.


Nope, if you wanna get hammered, just stay at home. Its much safer for you and everyone else on the road. The idea of getting fucked up at a bar seems so old fashioned to me. In the 21st century you would think humans could find something better to do.
 
It's illegal for somebody who is intoxicated to be served alcoholic beverages in a business so if they're drunk when they walk out the server should be charged with a violation.
 
I live in Massachusetts which has pretty strict liquor laws. Per the states info a normal sized adult can have two drinks in about one hour and still be under the legal limit.
Having a drink ir even a few over a couple of hours does not equal drunk.
 
My friend has told me that when people have pulled into his gas station for fuel he has seen open beer containers in their cup holder.

People are crazy especially since Jersey has one of the strictest dwi laws in the country. Not surprising since many of our tourist are from Philadelphia.

The problem is that there isn't much public transportation available past 11pm throughout most of the U.S.

Uber might change that however.



But yeah most cops really won't bother anyone unless they are being a public nuisance. There are asshole cops who will trump up charges, but I don't think they are the norm. One time I left a bar and I was pretty wasted. I was getting in my car to get my jacket so I could walk home (I was sure to enter my car through the passenger's side). There was a cop in the parking lot and he approached me and I told him what I was doing and I explained the situation to him and he actually gave me a ride home.
 
I suppose, especially since populations moved out into the suburbs. Public transportation outside of urban centers is practically nonexistant, so unless you have a designated driver, you are best staying home.

Then again, there is Louisiana, a.k.a. "the drive-thru daiquiri state". 😕

Always wondered this. In high school civics we had several officers come to class and talk about law and shit and I think this question was raised.

Yes and No. The laws in most states are so ambiguous as to be totally unenforceable.

In Kalifornia, there is zero tolerance for *driving*. DWI, driving while intoxicated, .08 and above, and DUI, driving under the influence, anything measurable.
 
Thats why in the old days peeps would do a couple of lines before going home to straighten out.


Man its a miracle everyone didnt die back then. Hell in NYC in the 70s there were dry bars that catered to people who wanted to dance on coke and luuudes.



Now responsible adults take uber rides or go with responsible friends. Like we used to take turns and stuff.


Now I have evolved to drinking really good alcohol at home.

Except for every single person who leaves the bar and isn't drunk. And since most places also have laws saying it's illegal for a bartender/server to serve alcohol to someone who is already visibly intoxicated, theoretically no one should ever be getting shitfaced enough that this would be an issue. Now in reality, there are tons of bars that will serve people well into a blind stupor, but places that do that tend to run afoul of local ordinances pretty quickly and have their liquor licenses revoked.

Still, you're making the cardinal mistake of assuming that people only drink to get drunk. That's a little like saying every time someone eats, they need to do it to the point of vomiting. Bars are a good place to meet people, hang out, engage in friendly banter, play pool, or shuffleboard, or pinball, or old arcade games, or lottery machines, all while having a drink or two. You don't need to get shitfaced to enjoy yourself in a bar, and if you do, you probably shouldn't be in one in the first place.

When I was a young man having an open container was not illegal and I've drank a beer served me by a lovely lady on roller skates with a hamburger and fries at a hamburger stand (Sort of a Sonic with beer on the menu). I recall doing this once when the car parked next to me was a police car with two cops. Drinking and drunk are two different things and for a responsible drinker, like myself, those idiots who drive drunk should be locked up and have the key throw away. Thanks to idiots. drunks and MADD, I can no longer have a Budweiser with my Dinner at my favorite drive inn.

If it weren't for Bars and Pubs the US would probably still be subjects to Queen and there is good evidence they drank more framing our constitution, write the Declaration of Independences and winning the revolutionary war that we drink now.

Till the end of the 19th Century orphans were feed 2% beer with breakfast, we don't do that now because we have clean water but consider your angst is caused by those who overindulge and not by the bars and pubs.
 
It's always bugged me that it's (mostly) illegal to deliver alcohol to a residence.

Probably varies a lot between states.
