It doesn't work that way. FCC has to grant you a license to use a frequency and each application is allocated a frequency, a range, or a set of frequencies.
If you don't meet the requirements, FCC will not grant a license.

if my cell is sitting on the desk, then the speakers just go berserk at random times.
same happens in the car, when i am about to get a call, like asecond before. I can tell someone is calling me by the speakers in the car before the phone even rings.
