IMO, it's fine.

If "use" bothers you, ask if you can list them as a reference.

"Hey can I come over and fuck you?"

Is that what you say when you call a girl up on the phone?

"Hello, I'm just calling to tell you that soon, a certain company will be calling you asking about me. Please, do tell them good things. Thank you."

"I'm using you as a reference. Snitches get stitches bitch so I suggest you STFU."

Pretty much covers all your bases, legal and otherwise.

Exact wording of an email I used recently to ask for reference letters:

Do you think I could trouble you for a letter of reference so that I have one available for future positions I will apply for?

Had to do it via email simply because I don't see the people I was asking very often. I asked three people with the same message, they were all happy to oblige, and I received excellent letters from them.
