Does this sound like a scam?!

I was looking for a Nokia 8600 Luna

looked at ebay and some local craiglist ads. I was unavailable to find anything locally so I decided, instead of going ebay ( I don't own an account ). I checked some craiglist ads in some other states checking Atlanta ( my aunt lives there ). I saw this ad

I contacted him he sent me promptly after a few emails back and forth he said he would be willing to ship and asked to pay via money order. I of course said "No"

he said he was willing to do paypal or google checkout

I asked if he had any feedback he said "No" I google his email and this shosurplus sales name in his email and end up finding an ebay account. strange?! I email him on another email address on that ebay account, to see if it's the same guy he says "Yes".

I felt safer and paid through Google Checkout with a Visa CC

he said he had to ship it from his supplier... one from China

and he'd have a tracking number within a few days.... within a few days I did in fact get a tracking number and I felt relieved.

I missed the USPS delivery so I picked it up today open it up and.... I'll let the pictures do the talking

at that point I'm heated and can't wait to get home and contact this guy

I thankfully see him on msn he basically says "No way!" I say something like "Yes, way!" :p

I told him what I received and said I'd take pictures of the products I received and the packing slip. I send him all that including a video...

he says he will contact his supplier and he's never had this happen before

he's still on MSN and he says he emailed his supplier with all the info and they should reply by Monday ( since it's the weekend ).

Should I stick it out and take it as a legitimate mistake? or cancel my visa charge?

cancel the charge until he can ship you the correct part.you already gave him a chance, its best to play your cards safe now.

Just my 2c.

UPDATE:

he's saying if I cancel it will be pending because I paid via Google Checkout

the person who sold me the product wants me to send back the package to his supplier via USPS express mail with tracking...

I found out the person who sold me the phone was actually selling me a high quality knock-off, but according to him he didn't know that was the case.. hmmm sure

the supplier contacted me... and told me they'd get this sorted out when he received the package they accidentally sent me, he'd than refund the person who sold me, and the person who sold me would refund me... sounds reliable ( lol )

complicated, annoying... yes, I know

I swear an iphone is so tempting right now hassle free.. I love how none of this is my fault and I'm the one getting raped here

Especially considering this reputable phone dealer in the US lists the phone at $600, $275 should have been your red flag!

Hey, lose the blame the victim attitude. One day you will be victimized. You will not want the people you know pointing at you saying it is your fault.


And so what it ships from China? That in no way suggests it's a scam. A lot of the Items you have purchased in the last six months came from China.

Back on topic. It does not look yet like the OP was scammed. The amount of cummunication he's gotten from the seller is not something you'd normally get from scammers, unless they are dumb scammers.

He wasn't victimized though. Take some responsibility. HALF price for the phone... doesn't that sound a BIT fishy to you? It's a risk, and if you're willing to take it, own up on it. Yeah, it sucks, but the price would have been the biggest red flag on this.

I've been scammed before it isn't fun. But you learn from your mistakes.

Granted the seller was the dishonest one, it still takes two to tango. If something sounds too good to be true, then it usually isn't. Lessons learned, if you can't touch use see the product and there's no way to determine a seller's credibility then you shouldn't do business with them. It's Buying on the Internet 101.
