Heres the story...
A couple months ago, I was visiting another forums site that I go to and there is a thread about web hosting. I made a few recommendations (including myself) and said this is what we offer, take it or leave it and left it at that. One of the people in there banned me for spamming them. But the same person also said they havent paid their web host for two years and their site is still up.
Fast forward to today....I get an email from him saying:
You do realize slander is illegal? I?d like a letter of apology sent both to me, and the PHPWEBHOSTING stating that you were incorrect in telling them I hadn?t paid in almost a year. I?d suggest doing it quickly, because the voicemail has already been left with my attorney.

Only, I didnt tell his web host. Whoever it was that told, wasnt me. Of course, theres no way to prove it unless his web host can somehow trace the IP of the person who did send the email to them.

Aside from the fact that slander is spoken, and libel is written and he says he is going to sue me for slander, is there anything more I can do?
 
he's full of sh!t. he would have to prove you sent it, and then prove there were actual damages. the only "damage" is that he would have to pay his bill, which he should have done anyway. tell him to suck it.
 
If you didn't do it, let him waste his money on trying to prove that you did.

Remember, he has to show evidence that you did it, NOT you have to show evidence that you didn't. Let him worry about getting the IP, not you.

That's another good point, the damages are only the damages he received from having to pay off service he was stealing. Didn't pay = stealing.
 
Is he implying that he did pay? Because otherwise, how could it be libel or slander when it's a fact?
 
No. Ignore him. But save this e-mail as his tone is a threat of barratry, which is illegal. You cannot say, "I demand an apology or I will sue you". This guy is an idiot.
 
Did this person say he/she hadn't paid for webhosting for two years in a public forum? Not only might there be a record of it, but if it's public, anyone could've been the one to turn him/her in, not just you.

Furthermore, the attorney will probably blow it off after hearing the voicemail (if one was actually left.)

First off, it's libel, not slander. Libel is printed, slander is spoken. He pretty much doesn't have a case. Does he even have your address or real name?

You can countersue, but you must prove actual damages. Unless you are a practicing in the medical field (then, malpractice insurance shoots up if you've been sued at all under any cirumstance), you'd be just of a jerk as he is. Oh, and what state is he in? What state are you in? If he has to fly from Florida to Oregon to file papers at the courthouse, it's pretty unlikely you'll be sued

Yes, he is an idiot, and everyone hates him at this site. The only thing that keeps him from being perma-banned is that he is friends with the owner of the site.
 
Take a look at what he just posted on that site....
It's drama because little herbs who catch feelings on a forum decide to **** with people's real lives because of it. Honestly, I talk a ton of a sh!t, and i enjoy people talking sh!t back to me, it makes the day go by so much faster. but to start ****ing with a person's livlyhood (the way I make my money, promote my company, and support my clients) is not only a bullsh!t bitch move, it's down right wrong. I've now lost all of my files from that server, all of my emails, all of my clients' sites and sh!t, all of my databases, my finances, both personal and business related, two years of forum topics and blog entries, over three years of photographs that I'm hoping i still have at home, i know I have most of them but doubt i have all of them. Seriously all of this because you caught feelings on a forum. I would wish bad things on whoever you are, but you honestly aren't even worth it. Totaly unacceptable, and I honestly do hope that I never find out who you are, because I will go out of my way to make your life as miserable as possible. Let me find out your email address and name I will have your home mailing address and make god damned sure to have hordes of snail mail gay prn spam mailed to your home on the daily. you suck.

hes just pissed bc he lost a lot of stuff. i doubt he would even go through with it (empty threats) and even if he did, he cant prove something you didnt do. i would just ignore him.

i have actually been in a similar situation. i was blamed (along with some other people) for getting a guys tv show kicked off the air. well, i didnt contribute to pissing the guy off, but had nothing to do with his show. oh well!
 
NEVER take a single legal threat seriously unless an attorney is contacting you.
Period.
 
What a schmuck. If his business was so important to him, he would have 1) paid for his hosting, 2) backed up his data regularly, and 3) not bragged about how he's ripping off his webhost while he's giving out enough personal information to lead back to him.

He deserves what he got. His customers (if he really has any) deserve better, and will probably jump ship on him.

Any moron knows to back up your data. You never know what might happen. Idiot.
