Explain (and by States' rights, I mean social, economic, and foreign policy.

I'd say it failed to protect minority rights, even before the 17th Amendment (I think it needs to be repealed largely because it can be Amended without unanimous consent of the States).

The next confederal union should be the same as the Articles of Confederation, except for a few modifications.

Those modifications should be:

The "9 States" clauses should be replaced with "9/13 of the States";

entered into with at least 663 States (each State as they are now would have to be split from what they are now) to make amending it or ending it impossible;

the 11th Article would replace Canada with PR and also state "partition of existing States, with consent of their legislatures, shall be automatically recognized by the Confederal Union, but no foreign State shall be admitted to the Confederal Union unless 9/13 of the States consent to the same".

Clement Vallandigham had a brilliant solution, which was to divide the Senate and the Electoral College into 4 districts. That way, all 4 would have to be won in order for proposed legislation to make it to the executive's desk and in order for a candidate to win the electoral college, respectively. I believe that could've prevented the War to Preserve Government Revenue if it had been done before 1860. Unfortunately, Clement Vallandigham was arrested by King Lincoln and none of his proposals ever went into effect.
