Does the TOS purport to remove our copyright over any photos we post on here?

All comments and materials submitted to the Forums shall be considered non-confidential and the property of Anandtech, unless otherwise agreed in advance in writing by Anandtech.

I don't think you can take my copyright to my images away like that, and if you can (or think you can), I'd be very hesitant to post any more on here 😉
 
From a legal perspective, I don't think that would hold up in court. Focus on the "submitted to the Forums" part, the picture was not submitted to the forums, but a link was provided to the hosting service that hosted the website. You are merely providing a link to a photograph and (possibly) making comments on it, and are not submitted it. IMHO.

A) I am not a lawyer...
B) We dont directly accept image upload, so it would seem to me your 'comments' and 'material submissions' would be URLs not the content of said URLs....

Derek can comment more, but I do not believe the spirit or terms of the TOS gives us copyright to your photos. However, your thread posts do become Anandtech content (e.g. you can't sue us if your silly comment of the week is still available 3 years from now and you dont want your new employer to see it... 😉

also, if we enabled inline image linking we would not try to claim copyright.

that provision only applies to materials physically submitted to and stored in our database.

As a lawyer who doesn't have the slightest clue about copyright issues, I just wanted to hear it out of the horse's mouth, so to speak 🙂
