DOCKERS is trying to get my domain DOCKERstore.com

I just bought this domain like 3 weeks ago and i just got an email from them saying...

We represent Levi Strauss & Co. ("LS&CO") in intellectually property matters. LS&CO
is the owner of the federally registered DOCKERSCI trademark and the DOCKERS.COMCI
trademark (the Dockers Marks), among others. Through extensive global marketing and sales of its famous DOCKERSCI brand of products over many years, our client has built up considerable fame and goodwill associated with its branded goods, as well as a very strong consumer association between the distinctive Marks and our client's goods and services. Enclosed are copies of selected federal registrations for the Marks. As you likely know, our client owns and operates a website at -:www.dockers.com?

We write to you as the registrant of record for the - Dockerstore.com? domain name (the
"Domain Name"). The Domain Name creates unlawful confusion with our client's trademarks and with its website at -:ww.dockers.com? Indeed, your use of "Dockers" in the Domain Name constitutes trademark infrngement, dilution, and unfair competition. For such actions, you can be held liable for your profits (tripled), an injunction and our client's attorneys' fees.

Furthermore, your registration of the Domain Name violates the Anticyberpiracy
Consumer Protection Act, which imposes civil liability for bad faith registration, use, or sale of a domain name that is identical or confusingly similar to another party's trademark. 15 U.S.c. § 1125( d). The Act provides for forfeiture or cancellation of an infringing domain name, as well as injunctive relief and damages of up to $100,000 per domain name.

Your continued registration and use of domain name that infringe our client's trademark
rights in the Dockers Marks cannot be allowed. We must insist that you immediately cease all further use of any of the Dockers Marks. We demand that you transfer the Domain Name to ourclient, as well as any other domain name that includes the Dockers Marks or
any derivation of them.

We require a response no later than February 27, 2006. If you promptly agree to
transfer the Domain Name by this date, our client is willing to reimburse you for your costs in the amount of $100 total. However, if this request to transfer the domain name is met with less than full cooperation on your part, this offer will no longer be available. Further, if you do not provide us with a substantive reply by this date, we will advise our client to seek other legal remedies against you.

So what should I do??
take the $100?? or try to get more??

It sounds like they are trying to muscle you around.
Have no furthur contact with them except through an attorney, contact one and try to get some real cash.

you try to get more they can accuse you of domain squatting and just take it. Since it does not look like you are doing anything with the site eiter.

also their company name is DOCKERS... not DOCKER, so how do they have any right to take your domain?

Dockers is a trademarked name. Is Docker?

If your intent was to squat on the domain knowing who'd be interested in it, though :thumbsdown:

They are trying to muscle you. If you are using the site name legitimately you should be fine.
But it wouldn't hurt to ask a lawyer.

The anti-squatting policy of ICANN is pretty tight. Unless he can demonstrate a viable, believable reason for having that domain name, they will take it away from him.

you need an attourney...
however the traditional ruling in the courts is, as long as you are not selling a competing product, or one that could even cause confusion, then you are not infringing their trademarks.

he bought the domain dockersstore.com. While he knows Dockers is a brand of Levis. They saw him take it and now hell broke loose.

He's fvcked. If microsoft can steal mikerowesoft.com from a kid who's name is, in fact, Mike Rowe then he's fvcked. Most expensive lawyers = you win.
