What makes you think it was taken from a HTC made phone? The image string?

If it was taken with a dedicated camera, the photographer needs to be shot if thats all he could do or the camera smashed with the hammer.

the immage summery and buy defult any HTC phone when taking pics starts with IMAGE_xxxx so I know

Those are pretty bad. Camera phone or some crappy digital camera. Lot of noise too in those pictures.
