Lots of blame to go around on this one.

Parents of the first child for not making sure the baby sitter knew who she was to pick up.
Baby sitter for not making sure she knew who she was picking up.
The school for not verifying the the baby sitter was allowed to pick up that child.
The parents of the 2nd child for not educating the kid about leaving with strangers.

Anyway....is the school legally liable for children after school is no longer in session? I was under the impression that the school is not responsible for getting children home or policing who is taking them home and that they do it out of their own free will.

I don't think legally they do.

when a friend of my wife's started her 5yr old in Kindergarten she asked the school how is the little girl going to know what bus to get on? the school said it is her responsibility to make sure she gets on the right one. the school is not there to hold her hand and make sure she gets on the right bus.

When my daughter started kindergarten the school told us they had clear procedures in place to make sure the kids got on the right bus or into after school care, or to the right place to be picked up by parents. I can't imagine a school not having something like that in place for kindergarteners.
 
When I used to pick a kid up from daycare, I had to have two forms of ID and they still called his mom the first time to make sure.

Absolutely inexcusable. This is the school's responsibility, not the babysitters.

And the parents must be idiots to not introduce their child to the babysitter.

its teh parents for not introducing the child, the babysitters for grabbing the wrong kid. The school while partialy responsible is not the blame.

Don't leave out this Angel kid's parents for not teaching him that he shouldn't willingly go home with strangers!

First of all, this child wasn't getting on a bus. Secondly while the child is on a school bus, the right one or the wrong one, the child is still in the school system's custody. The bus driver is responsible to see that each child gets off at the spot they are supposed to get off. Obviously if the child gets on the wrong bus, this isn't likely to be easy, but the bus driver cannot just let the child off somewhere else. Bus drivers get fired for doing that.

Additionally, children aren't allowed to just leave the school when school ends. When children are enrolled, the parent makes arrangements for how the child will get home. That might include just walking home, but I don't know of any public school that lets 5 year olds do that. And most schools won't let older kids walk home either, if it's very far.

 
Why the hell didn't the parents at least give her a picture of their child? I can't blame the sitter, I blame the moronic parents.

I bet she feels horrible about it too. If not, theres something wrong with her.

And I'd fire her arse if she brought home the wrong kid. I mean WTF, did you even ask the kid his name to make sure it was the right one?
 
hrm.. i don't remember having to wait for parents to pick up their kids. i would always just walk out to the parking area and get into my moms car. and i'm pretty sure the same for my sister. well, in kindergarden anyway. after that I know the school didn't wait around for the parents to pick up the kids.

but this is late 80's to mid 90's. dunno about now.

same here.

also i have picked up a few diffrent children from school. NOT once have i had to show id or anything. it was just park yell for the them to come to my car.

oh this was even last year.

Times have changed. With so many people getting divorced and vilifying their ex-husbands, they need the schools to enforce their custody orders.

Choosing to have them in place and being required by law to have them in place are two different things. Don't get me wrong, I think they should have them in place - I was just wondering if they have to.
 
at my kids school you cant pick up a kid unless your name is on an authorized list of people the parents have designated ahead of time....

Every school my kids have gone to do this too. They walk the littler kids (kinder to maybe 2nd grade) to the bus and put them on, checking off each child on a list and with kids who are picked up, they hand over the kids to the adults personally, checking who it is. The older kids are allowed to walk the 20 feet or so to the bus, but they are checked off one by one to go, and the teacher MUST see the adult pick up the kid and recognize him/her. If they do not recognize you, they will NOT let the child go. They will take you to the office and call the parents or check your ID against the list of approved adults in the child's file. If you take a kid and the teacher doesn't notice and check the kid off on the list, they will call the parents, and if you don't confirm that you took them, they will call the police. If there is a kid who is supposed to be on a bus and isn't, the buses will sit there until the missing child is accounted for.
