Do you have any recourse on a cell phone contract?

Had a 2 year contract with a cell phone co.

Lived in center of state - no problems.

Move to SW part of state (still their coverage area) - terrible service - phone won't even ring.


I go through cust. service, etc for weeks. Repair kept saying they'd upgrade the tower.


In meantime - I depend on phone - I had no landline. Phone would not dial or ring inside and lost connections repeatedly. Keep in mind I am not in a fringe area - rather WELL inside their coverage area.

Finally I just call em up and tell em to cancel it and I'm not paying (my frustrated go to heck action). . .

So now I'm getting a 400$ bill every month. Have not paid on it yet.

Do I have any recourse?

C'mon ATOT lawyers - and those that have experience being screwed by someone - tell me what to do.

I just cant stand the thought of paying for something I wasn't getting and that noone gave a flying you know what.

That will affect your credit rating and you might not be able to sign with the same company again (The second one might not be a problem fot you).

Edit - And they might put you in collection.

Well since no one else has replied, I just wouldn't pay it. There are other cell phone companies out there. And even if you want to go back to them, can just make up account information.

NM...seems you should be able to break this deal by paying something since they can't fullfill their part of the contract by providing you service.

Find a copy of your contract. There must be a clause in there somewhere that says that you agree to pay them in exchange for cellular service. Since you're not getting it, they are in violation of their contract.

Of course you need two things:

1. A copy of said contract.
2. A law-talking guy

That's what I was thinking too... find out if they've violated the contract with the poor service to an area they claimed to have service to: misrepresentation or something like that.

Throw a big enough fit that you can not get service wherre you either live or work.

As another stated, you should not have to pay for something that they are not providing.

Sprint had a situation like that with me and offered to cancel the contract. I had moved to a temp living quarters that could not get reception. when I finally to a local cell office manager to the apt, they made the cancel offer.

You should be able to get out of it.

T-Mobile has you change your billing address to your new address, & if they confirm there's no coverage at that address you're out of the contract.

They may claim that there is coverage in the area.

If the coverage is not up to par, then you should be able to bail with no penalty.

unfortunately, Ausm is correct. most of the cellular companies mention in the contract (that customers signed on foolishly) that their 'service is not guaranteed'.

that's right my friends, those evil companies never ever guaranteed any kind of service from them, no matter where you are, even in the middle of their so-called coverage area. either you pay your bill every single month until your contract expired, or pay the ETF.

this is a lesson to us all. never ever ever sign any commitment contract to any one mobile providers just to get their stupid 'free phone' or '$100 rebates for a highly overpriced newest most uber exclusive phone'. buy your cell phone somewhere else, and you can switch providers anytime you want.

cell phone contract is teh evil :evil:

Cellular providers do not guarantee service, even in their service areas. I found that out the hard way. I live in the middle of Lubbock, absolutely no service. When turning corners in some areas your calls will be dropped as well. It royally sucks. To me if you are in the coverage area, it should have all 5 bars worth of service.

your screwed cell companies share info and its all tracked by your credit raiting so if you owe one of them 400 bucks you proubly won't be able to get another phon without a 200+ dollar deposit

Well my credit is fubarred anyway. I think this is going to stay on my low priority to pay list. I'll eventually get something paid if I owe it. I've been paying on hospital bills for years. Like I said - I just can't stand the thought of being screwed.
