I am not sympathetic to illegal aliens who are taken advantage of by their employers. The rules of the game involve illegal activity from the start, and everyone involved is taking a risk. When a large company is raided by the ICE agents, they usually claim innocence and declare that the employees are contract labor actually working for someone else.
Wendy's lawyers will play all the angles and drag things out. The strange thing is- both Wendys and illegals will still be working together. These people want the work, and Wendys has the jobs. Most of their employees could care less about a lawsuit.
Oh, by the way, when you order at my local Wendys, they repeat your order in Spanish so that the crew knows what to prepare.

I feel bad for them. But then I remember..... man 9 years of them not paying taxes and having us cover them living here with our taxes that we pay.

They were here legally and were participating in a program where they worked until they gained their citizenship.
Wendy's/their lawyers dropped the ball and their program expired before they became legal citizens, because the lawyers didn't file their paperwork on time. It wasn't until this point that they became "illegals."
They deserve to win this lawsuit.

I'd imagine all they have to do is claim like 3 dependents so no taxes are taken out. Then just not file.
So you sue Wendy's for firing them when it's mandated by law? Sue the law firm because it was their responsibility but not Wendy's for doing what was necessary. The same people backing the illegals are the ones that would be bashing Wendy's if they had been busted for employing them.
This is why the guest worker/sponsored worker programs won't work:

Well, the article keeps refering to them as illegal immigrants so i assume that's what they were. If they were in fact here legaly then they do have a legitamate case, IMO.

The only thing these immigrants fvcked up on was not making sure their lawyers were doing their jobs. Can they win this case I have no idea but I applaud them for trying to become a citizen through the legal way.

Program or not...they're still here illegally, and should be sent home in a box...maybe with a bag of Wendy's fries...they ARE entitled to a refund IMO for legal services NOT rendered, since the law firm apparently dropped the ball...

actually what happens is they'll be provided with fake SSNs so that the payroll taxes get taken out.
and none of them are making enough money to pay income taxes. very few people in the lower 50% of income pay any income taxes. so it's not like we're losing tax money on the deal. plus, they buy stuff and have a place to stay, so they're paying sales (well, maybe not in oregon) and property taxes.
and guess who picked the counsel? it was wendy's. wendy's was the agent of the immirgrant in this transaction.
actually, they could (and are) suing for malpractice. so, not just giving them back their money, but all the tort damages you can think of.
