do I have a lawsuit?

Let me preface this by saying that I hate lawsuits and lawyers. There are a gazillion friviliuos (sp) lawsuits out there and it makes me kind of sick. I wanted to get the opinion of anandtechers on this pls.

I went to a perstigious dental school for a check up and cleaning b/c its cheap. Like half price and I am broke. A cleaning is $50 and so are cavities filled. I have pretty good teeth and wanna keep them. So they found 2 cavities and I waited 2 weeks for an appt for either a cleaning or to have the cavities filled. They don;t do it all in one day and stretch things out there. Anyway make a long story short, I wanted the cavity fixed first b/c it was giving me discomfort. This cavity was under a filling so they had to grind out the old filling before they could grind out the decay. SO they did all that last Friday. When I got home on Fri I got a fever and was sick all weekend and yesterday. The tooth aches worse than before so I went back today. The ham-handed kid tapped the tooth w/the mirror thing and I saw stars. I nearly jumped outta the seat. They told me that now the tooth needs a root canal, but they wanted to reverse what they did last Friday and see how close to the nerve the decay went. I was upset and not ready for anymore grinding, so I left. I said that maybe I will come back tomorrow or something. I get outside and call my Dad. He says that I should either get a second opinion or go back inside and have them do it. After I hung up w/Dad, I was feeling lightheaded and passed out on the sidewalk. I knew it was gonna happen and grabbed a passer-by for help. He was a help and got an ambulance. They took me to the ER and I just got back. All the blood tests looked normal and the Doc said that I passed out b/c of the stress and pain of that knucklehead tapping my tooth. Now was I wronged by that school? All the work the seniors do is double checked by a verteran dentist. I sure want my money back at the very least. It was $90 for the Xrays and $55 for the bungled cavity job. I don;'t think its a good idea going back for the root canal there, but should I sue? thanks

I assume that going to a school like that you probably signed a waiver. If thats the case, I would say your pretty much screwed.

If you did sign a waiver I don't know if you have much recourse.

However it's up to you to prove they were negligent, I don't really know anything about dentistry so I can't say. If they were in error, then I'd say reimbursement and pay your bills to have the tooth fixed correctly would be fair.

Nope, you don't have a case. You had the cavities previous to going in and unfortunately one cavity isn't exactly like another, just like people's mouths. They did what they could, but all of our bodies react differently to medicines and procedures (dental, etc)....

Then again, 2 years ago, I had a dentist drill my tooth for a filling and forget to put in the filling material. I contacted him two weeks later, and he filled while feeling like a total dumbass. That would have given me a case, but I don't waste my time with things like that as my time = money.

If you've got the time and money to sue, go ahead. I doubt you'll win anything.

Sorry to hear this but you should know the risk letting a dental school senior do your teeth.
I would only let them clean or pulling out my teeth but nothing more. $50 for cleaning isn't cheap either.

I say there is no case for this one.

if you didn't sign a waiver, go ask for your money back first, then consult legal help.

I can understand it was painful, and I've been through quite a bit of pain before, and have never passed out. I know people threshold can vary, I was just surprised.

This case does not, IMO, warrant any lawsuit. It would be another thing if you passed out driving, or suffered some serious injury as a result of where and when you passed out. Based on what you have stated, I can't see any basis to find any significant damages, a prerequisite to a lawsuit. You might be able to threaten to sue them in order to recoup part or all of the cost of subsequent dental work, but frankly it does not sound as though they materially worsened your dental situation, so even that is tenuous. I agree you may have been wronged, but I can't see how you have a cause of action as a result.

This is America, so of course you have a lawsuit.

Your a pathetic loser if you sue, but you have a case.

I would march down there and demand that one of the "REAL" dentists take care of you right away for free. If they balk, then maybe you can justify suing them to be vindictive, but suing just to sue is pathetic in my book.

I didn't sign a waiver, but it sounds like it make no sense to sue. Root canals cost a fortune, should I have them do it? Hell NO, right? Now the bills are gonna come for the ER visit and the ambulance ride. Thats all I need now is more bills! On a brighter note, I had a job interview before going to the dental school and I was told that I am a very strong candidate for one of 3 jobs. Thanks again

I don't think it's unusual to find that a root canal needs to be done under an old cavity--I just went through the same thing.
Did they completely re-fill the tooth Friday? Or just remove the old cavity and grind away the nasty stuff, then pack it up until this week when they would finish?
Probably during the removal of the new nasty stuff is when an experienced dentist would suspect there's more than just a normal cavity.
That may just be the real difference between going where you did and going to an experienced dentist.
When you're not in pain, maybe you can discuss it with them, asking that everything you've spent is applied toward what the total cost would have been had it been correctly diagnosed.
I will admit that it's pretty hard to be rational when you're in major pain.

Yes it is for this neck of the woods. Usually a cleaning is at least $100.

Take the money you were going ot spend on a lawsuit and GO TO A REAL DENTIST.

I wasn't gonna spend a nickle. The gameplan was to find a slimey, trip and fall lawyer that would take this on a contingency basis, and negotaite a settlement in the 6 figures. Thats not gonna happen though.
