Divorce without a battle

lokiju

Lifer
So my good friend finally split from his wife for good this time for irreconcilable differences and is now living in my living room until things get sorted out.

He and his wife wish to use ONE lawyer to do all the proper procedures and paper work for the divorce but neither of them knows if this is normal or possible and I have no clue.

They're on pretty good terms still but its just the irreconcilable differences that is causing them to split so there isn't any real hard feelings against each other and they both just want the least hassle to do things properly.

Any advice you guys can give that I can pass on to them?

Thanks!

technically yes.

You can get a divorce over the internet for $50. Of course you have to handle custody and asset split on your own.

well if they can settle it themselves...why do they even need a lawyer? (unless they have kids, a house...all that stuff)

One lawyer? If he does he will get the shaft. Spending a little more money here will keep him from losing a LOT more money in the long run. Divorce is war for the most part, tell you friend not to play the French.

Sure, just have him follow the guidelines setup in their prenuptial agreement.

 No prenup.

Biggest this is the house they own, I guess they're thinking about one of them buying out the others half, they just haven't determined which one gets it.

It can be done. I am a perfect example:

dirtboy & wife get into a huge fight.

Two days later dirtboy is served with divorce papers.

Two days later dirtboy & wife meet with wife's attorney to divide assets. Attorney wasn't present as we already knew what we were dividing.

9 days later dirtboy moves out of state, never to see, hear or speak to wife again.

60 or 90 days later the divorce becomes final and now ex-wife's lawyer sends dirtboy a bill for the remainder of the fees -- a few hundred dollars.

dirtboy sends check and has been happy ever since. 🙂

RED FLAG! They need their own lawyers.

Lawyers = more money than you'll spend on a house.

Just have whoever isn't staying take over the entire mortgage.

Doesn't account for equity.

any remaining equity can be split if/when the house is sold.

[Madden] Boom! There's a flag on the play! [/Madden]

Personal Foul! Roughing the Divorcee! Penalty is half the distance to the goal! Repeat first down, hire new lawyer!

BEWARE! This will not take the other spouse off the note, and they will remain equally liable for payments, regardless of what the divorce decree says. They need to sell the house or refinance.

Selling the house and splitting the price would probbaly the simplest and easiest option considering there are no kids. Use the 10K to pay for the real estate agent.

the main reason divorces are so ugly is (usually) because of the woman. alot of them have nothing to show for their years of marriage and when this fact smacks them in the face upon divorce, they start scrambling thinking that they deserve more.

if there are kids involved and they were forced to stay at home this is plausable arguement, if not they need to just pack there bags and keep on moving. but why walk away when you can claw your way to money (precious dollars that will pay their rent, car loan, and shopping habbit until they find their next victim)

as well, the goal of relationships for women is children and a family. when that falls through they want to punish you for the time you wasted while they could have been out finding 'the right one'.

its amazing what a pound of loose flesh can put a guy through.
