Divorce Question - Child Custody

Hi guys
I got a couple of questions about the whole child custody and 'mediation' proceedings. Lets say that a couple has gone through mediation and were not able to come up with an agreement on the child custody question. The mediator has made an recommendation to the judge. My question is: Does the judge typically just follow through that recommendation by the mediator regarding child custody? Does anyone have any expereinces where the judge just went against what the 'mediator' recommended?

And yes, they usually agree with the mediator, unless there's pretty good reason to go a different way.

The mediator recommended the children stay with mom (where they are staying currently) and have alternate weekend's with dad. (i'm asking this for my sister). I think its a good recommendation; but then again i may be biased. I just wanted to kinda know what our chances were of the judge upholding this rec. I know the husband is going to complain about this since this way he will have to pay more child support.

Keep in mind the kids have been living with the mother since july; ever since the divorse papers were filed. They go see their dad couple of hours a few times a week.

Mom's typically do win custody, especially in the case of small children.

I was fortunate enough to be in a "dad friendly" state during my divorce.
Yes, they usually follow the mediator's recommendation.

She should win, California is an anti dad state. Very bias against men.

Lots of states have "Joint Custody" on the books as the preferred arrangement, but very few couples can actually make it work, the logistics of true joint custody is hard work & requires effective communication between the divorcing/divorced parents.
