a girl(in her early 20s) i know wants to get a divorce from her husband. shes been married with him for about a year(hes around the same age). here's the interesting part: turns out he's gay(and has been all along), and the only reason she married him was to somehow give off the impression to HIS parents that he is straight(dont ask me why they felt a marriage was the best thing for this). she doesn't make too much money im guessing, and supposedly he was going to sign her up for some kind of benefits since they were married(which he never happened). well i guess the guy met ANOTHER guy and he doesnt like the idea of being married so now he wants a divorce. but she obviously doesnt want to be left empty handed and wants a couple grand in return, and the guy doesnt want to pay him. yes, this story is straight out of a jerry springer episode, but shes looking for advice on whats the best way to approach this without it getting nasty.

I'm a divorce lawyer in Houston, and I have no idea what the problem is.

What state is this in?

Does he just want a divorce, and he wants to know if he will leave the marriage with any property?

Did anyone know that this was a sham marriage? Anyone who would be willing to testify?

Long term marriage?

NC and a lot of states are no fault. Cheating has no bearing for divorce.

Call the cops and report her for extortion. After the report has been filed and he has a copy, then file for divorce.

No fault can be a bit of a misnomer. "No fault" means that you can file a petition for divorce without alleging fault.

Texas is a no fault state, but you can sue your spouse for divorce for cruelty, adultery, etc. and receive more than half of the property of the marital estate.

She just wants some kind of payment from him I guess. Her family knows its a sham marriage, and so do some people at work. Her friends and family might be willing to testify.

Honestly I think the guy will probably cave in with all the hassle/court hearings and give her the money. I just told her to threaten him by calling up his commanding officer and letting him know he's gay lol.

The more I read over this, the more morally reprehensible this becomes.

A man decides that he wants to convince his parents that he is straight, so he decides to marry a woman.

The woman marries him for insurance and other benefits of the marriage.

Things don't work out, and she feels cheated because she did not get the benefit of the marital bargain, I suppose.

He wants to finally be gay in peace.

She wants a couple of thousand, and she'll give him a divorce.

Wow.

Both of them need to be stoned to death.

The man needs to be killed bacuase he does not have the sack to come out to his parents. He decides to make a mockery of marriage in the process.

She deserves to be stoned to death for greedily going along with this scheme for financial gain. And now that she is confronted with a way out, she is going to essentially blackmail him. Nice.

While all states have some firm of alimony, it is harder to get in some places than in others.

Just walk away from it.... That's the problem with people.... They get into a marriage then one of them wants out, and a paycheck to boot, just walk away.. If there where kids, property or other stuff involved I could see taking someone to court. But let?s face it, any lawyer that would take the case is going to want his cut, and you can't squeeze orange juice from a lemon. She is still young and has her whole life in front of her, just walk...

Let me see if I understand this right:

1. girl marries gay guy to give gay guy's parents a deceptive impression that gay guy is actually straight, and to get financial benefits from guy in exchange
2. gay guy meets another guy and sparks fly
3. gay guy feels that being married to girl = cockblockage, and wants divorce
4. girl says "fvck that" and wants money from gay guy, in part because she never got the benefits described in (1)

Morally, it seems like she's in the right, in that she had some kind of (verbal?) contract with the guy that on being married, there would be a financial benefits quid pro quo. However, on the whole I would have to say that both girl and gay guy were stupid to get into such an arrangement in the first place.

It was an immoral deal in the first place, and it would be against public policy for a court to give any sort of recognition of such a deal.
