Locking up people who haven?t done anything wrong is worse than un-American and a violent attack on the most basic principles of Western jurisprudence. It is contrary to the most essential notion of human decency. That anyone has ever been subjected to ?preventive detention? is an outrage. That the president of the United States, a man who won an election because he promised to elevate our moral and political discourse, would even entertain such a revolting idea offends the idea of civilization itself.

Obama is cute. He is charming. But there is something rotten inside him. Unlike the Republicans who backed George W. Bush, I won?t follow a terrible leader just because I voted for him. Obama has revealed himself. He is a monster, and he should remove himself from power.

More to the point, there is solid historical preference (and Constitutional grounds) for suspension of habeus corpus. It was done both by FDR and Lincoln, in times of crisis as we stand now with our overseas contingency operations. Kudos to the Obama admin for standing strong and doing the right thing in the face of these idelogues! :thumbsup:

I don't know who Ted Rall is but I'll tell yahs what I think this 'preventive detention' debate is about:

It's a set up. A classic 'Rope-A-Dope'

I guess anything is possible but it's very difficult for me to imagine that a President like Obama with his background in Constitutional law would lead the charge on preventive detention. I do, however, think these guys are smart enough to use a debate they initiate as a means to an end they desire.

Think about it.

Closing Guantanamo went nowhere fast BUT not only is it the symbol of an unconstitutional detention and interrogation system it is Exhibit A in the debate on preventive detention.

If you don't want to close Guantanamo you need a legal framework for indefinite detention.

This is the classic, "Where do you stand?" If you support Gitmo you have to support a legal framework for indefinite detention.

Even more subtle (and this is much more of a reach) the public debate on indefinite detention and 'Prisoners of the War on Terror' is a significant shift from the last 8 years of Bush/Cheney rendition with no legal basis, oversight or authorization by Congress.

This is where these guys are slick - the emphasis being shifted to matters of Law rather than of War.

First you have to build a prisoner of war camp.

I say build it up by the bearing straight in Alaska.

Lincoln's suspension of habeas corpus was ruled unconstitutional and FDR's internment camps have only not been ruled unconstitutional because there hasn't been another case with it that has come up.

Obama's 'preventative detention' is an idea that should never see the light of day, it strikes at the heart of a free society.

Obama is a class act, he wants to close Gitmo and open a "preventive detention center", he is against torture and pro rendition.

Oh, are you saying the XMan is a leftie? Do a search for his threads. He has one that says the Mr Obama targeted Chrysler dealers owned by Republicans to close.

to the Op: democrats generally don't agree all the time. It is this way because we think for ourselves and aren't led by am radio and fear news. So if you see a critical piece on the president from a liberal source, Rejoice! for this means that the system of checks and balances and the press are working. I'm sorry that the republican press wont attack those on the same fence. I guess thats part of the reason the fence keeps getting moved on you guys :)
